When 50% of the Necron army is killed each squad takes an Ld test. If the test is failed the squad phases out of the game, But if it succeeds the models gain +1 toughness until the Necron players next shooting phase.

Does not affect:

C'tan stargods, no explanation needed.

Scarabs, I'm guessing that they are too small to carry a phase out thingy...

Tomb spyders, Tomb spyders don't phase out. They are left on the battlefield immobile until the next necron attack.

Pariahs, I don't know... just seems like a good idea to me.

Maybe if 75% of the necron army gets destroyed the phase out rul would work better... (if the necrons are losing a +1 toughness could help alot)

Honestly I would rather it be as a per squad basis and I don't really like the idea of Necrons gaining toughness, they are made out of extremely tough metal and I don't see a reason for them to get any stronger mid-game.

Instead, for each squad that is required to make a moral test for losing 25% casualties or losing combat they must do so against their base leadership and is never subjected to any negative modifiers. If that squad fails the check they immediately phase out.

This will make them harder to finish off in combat but also slightly weaker to shooting as a failed moral check will ALWAYS mean the loss of a squad

That sounds like a pretty big risk. Decent round of shooting then a bad roll and WOOSH no more necrons. I think a 25% of models left but per unit would work. Unless things like Pariahs, Monoliths, and C'tan get nerfed, then I see no reason to keep Phase Out at all.

I dont like the idea. Makes necrons too good! With high ld they gain too much t during game.
