2 questions on him...

1.  Can he be taken in a Lost and the Damned list (as an HQ choice from an allied CSM list)?
2.  Can he take a chosen bodyguard?

1-The rules for Fabius bile state "A Chaos Space Marine Army may include Fabius Bile. If you decide to take him he counts as the Chaos Lord Choice".
The Chaos codex lists it's army lists as "Chaos Space Marines Army List" on page 21. The LatD listing is labelled a "Chaos Horde Army List" on page 42 of the EoT codex.
While the LatD army can have 0-1 HQ slot as an ally, Fabius Bile can only be taken in CSM armies. Since the LatD is not a CSM Army but a Chaos Horde Army I'd say no he cannot be taken in LatD armies.

2-Yes. Fabius Bile takes the Chaos Lord spot and the Chosen Unit entry denotes that "4-19 Chosen can be used to form retinues for the Chaos Lord and/or his Lieutenant."

Look's like you posted your question a little before I got mine up, and I've taken a beating for it, LOL! I found this on another forum and I think it answers your question. I believe he can be used, but I also don't think you can give him a bodyguard, but I'm not sure.

I've been thinking of using him in a group of thirty plague zombies. The idea being they're denizens of his current home planet, failed experiments. With thirty fearless zombies to protect him, I think he'd last a long time on the table in combat, but I haven't proxied it out yet.

I'd be curious to see, or hear about your list as well. I think LATD fits his background pretty well and I'm looking forward to making the army.

I suggest, reading, thinking and responding rather than reacting next time you decide to post. It will save a lot of headache and spare us the poor use of sarcasm.

The FAQ for the lost and the Damned says that a special character may be chosen as an ally. As all the special characters say "may be taken in a chaos marine army" or, more restrictively, "emporer's children army" then yes, I do this that Fabius Bile may be taken by LatD.

According to the CSM Dex, fabius is no longer legion specific.
The FAQ does state "Legion Specific characters". Fabius is not "Legion Specific"

Semantics I know but all the same it would appear that Fabius cannot be used in a LatD army by the strictness of RaW.

This isnt rules....but its some nice background found in a white dwarf for fabius. neat character who is slaaneshy, but serves the common cause of chaos.
