The cops I have heard from all said it was a bad shoot based on what was/is known. They didn't all use those words (well one did actually) but the police I know aren't all that pleased about any of this for lots of reasons.

The NCO (Frackman) was driving and pretty much "cornered" Loehmann into the situation by driving right up to the kid.

Loehmann is an adult though, right?

Not quite. There is a big distinction here, I think, and that is that when you were in those situations, you were a soldier in an active war zone, not a civilian law enforcement officer in Cleveland, Ohio.

I have had the experience twice and still not use to that type of situation but I do have my training to fall back on. As in trust in the vehicle armor and the 28 layer of glass and polythane layer ballistic window. Loehmann has no experience and armor he can "rely" on. Frackman drove into that situation putting Loehmann into a predicament that went "Oh **** he got a weapon" and went South from there. I can't really blame Frackman since he was going by piss poor intel on the situation but he is the NCOIC and should have known better then to drive straight up to a possible "shooter". I place a good chunk of blame on the dispatcher for not passing along the possible intel of "kid/minor" with a possible "toy gun" which would have change the dynamic's of the situation.

The fact that Loehmann receiving a bad performance eval from another department would have bearing but the words use to describe his range behavior sounds like a personnel issue then a professional issue of a key leader in regards to Loehmann. Which the "bad" eval was not consider(?) in the hiring process of Loehmann. Since the LEO is like the military one's performance eval of the department stays with that department. I mention earlier though the lawsuit needs to cover both department plus the individual who gave the airsoft pistol to Amir

But either way, it appears that the procedure followed was not what was recommended by experts or the training these officers underwent.

And I think that if an officer has been evaluated as being deficient in his responses under pressure and wielding of his lethal weapon and who lied to superiors then that damn well should have been passed along when the other police force was considering hiring him. Someone who cannot maintain their cool, assess situations and lies to those in command does not belong in the police force. Period.

It's not his fault that he doesn't have enough mitochondria, and in any event, invisibly choking the kid or blasting him with lightning were hardly appropriate responses either.
