As for Doc Thunder, Spack (here on Dakka) is in contact with him trying to get the PhoenixWargamersClub pages back up via a different host.

You could apply some femine touches to your cadians - start with a nice foundation, bit of blusher on the cheeks, lip gloss on the lip, long eye lashes etc and im sure you could get some long hair from the space wolves

Sculpting and casting your own figures is admirable and legal. So is modifying bought figures by Greenstuff etc.
Modifying GW figures and then casting copies is copyright violation whether done for personal use or for sale.

Except there are no GW female cadians. Just the resin ones that were produced a while back for The Phoenix Club.

Oh, since the resins in question are not GW sculpts, the person they they should be contacting is the artist. However, since he's never taken out a copyright on it due to the complications which would arise from GW's copyrights, and lives in the US rather then England where the above poster is based, while it's protected under US law, as far as international copyright goes it's fair game according to Berne Copyright Agreement. Depending on who sues the counterfitter, if the artist does, it would probably end up in EU court, where the artist would lose due to not having a international copyright. GW could take them to English court, but it would be bogged down for years due to the implied consent to TPC to make them, if he were a member of said club, and GW might not win.

Modifying and reproducing miniatures for your own use is not illegal, at least not in the US. This is right protected by Fair Use laws. Use of reproduced models in official GW tournaments may be against tournament rules, but it is not illegal.
Modification and reproduction of any item you own in full for your own use is always protected unless the result of the process produces:
A: An item or substance that is illegal to own (producing your own methamphetamine, or a fire-arm with an illegal fire-mode, for example)
B: A item or substance that is restricted for use without obtaining a relevant license. (A motor vehicle, or radio transmission equipment, for example.)

The point is that if this guy sculpted the models himself from scratch, makes an effort to create something original (should not have IG emblems, weapons, etc), and does not call them Cadians (which identifies them as IG) he should be fine. In other words, no one is stopping you from sculpting and selling female soldiers.
If, on the other hand, these are made to look just like IG or if he is selling them as IG, or the final product was produced in whole or in part by using Citadel/GW models during the casting, then the guy is in violation.
I, for one, think using non-GW models in your army is a great idea, no matter what is said in the BRB. I can buy and proxy whatever I want (and even play with them if my opponent agrees). I used some great Warzone models as Ork Dreadnaughts. And female soldiers in an IG army is a great idea. But it isn't right for this guy to profit off of the GW name (if that is what he is doing). Like I said, if he is not, more power to him. And send me the link!

Ok... to summarize since some people seem to be unaware of what the hell anyone is talking about...
The Phoenix Club commissioned an artist to sculpt female bits for Cadians. These are basically torsos, heads, and legs that are more or less compatible with GW IG Cadians, IE they look like what a Cadian uniform would look like on a woman.
GW approved this, with a few cavets.
What xceptionzero proposed before being blanked by the mods, and leading to some confusion, was to copy those resins cast for TPC by their in house artist, for use by some sort of club in England, as TPC, as I've given to understand, could not distribute there, or something, which is causing a titanic price difference between what US gamers paid for them and what UK gamers pay for them.
Personally, I don't see the problem as long as they received permission to do so from TPC and/or made the group in England some sort of local branch, which would cover everyone's collective asses legally speaking and give UK gamers the same access to these high quality bits as US gamers. I'm sure that the US artists would want a percentage, but probably nothing near the scale of difference currently seen on eBay.

Ok in response I am aware that replicating GW stuff is a MAJOR NO-NO. I also believe in IP and copyright.
The ig female casts by the pheonixwargamersclub were created independantly of GW and not modified GW plastic or metal minis.
These casts are no longer available as far as I am aware.
With this in mind I am currently scratchbuilding in green stuff my own "IG style" Female troops. Thus by producing directly in green stuff I hope to avoid any suggestions I am ripping off GW or the Phoenixwargamersclub.
I had no intention to profit from any of this. If anyone can think of a better way then advice is welcome.
My greenstuff "ig style" legs are complete and due for first protoype casting run next week and the torsos are still being worked on.
As I live in Nottingham and work over the road from GW HQ I will be contacting them prior to even giving some to a friend or anything else.
Will post a pic of WIP in the next few days

Dakka policy is to uphold copyright.
Under current copyright laws, items may only be reproduced for the purpose of comment, criticism, review etc as defined in the Fair Dealing (Fair Use) provisions. THIS DOES NOT INCLUDE MAKING MULTIPLE COPIES TO USE AT HOME.
AFAIK whether a new IP item is made in the US or Europe, it is equally protected by copyright without a legal need to register it.
If you make exact copies of a GW miniature using green stuff, you have technically violated their copyright, however the difficulty of making lots of copies means that GW probably wouldn't be worried.
If you take a GW model and modify it with green stuff, that is totally legal as long as you don't make copies.
If you make a completely new model, similar in look to the GW model but different in the IP protected details, you would legally be able to reproduce it. I assume this is what the Phoenix Club people did. The tricky bit is defining what are the IP protected details.

Not true. The Bern accord does not recognize US 'postal' copyrights (at the moment, it's still being hashed out in EU courts), IE in the US if you mail it via the US postal service to someone other then yourself, it's copyright for 7 years after the date of mailing. Some other types of IP are also not protected or recognized internationally and/or become subject to public domain at differing dates/times. A patent, for example, only lasts 3 years in Japan, but I believe it's 7 in the US. (Amusingly enough, in some middle eastern nations, one cannot copyright music. Take that RIAA!)
However, I understand and respect Dakka's position on the issue. My statement is still that if the individual in question were to get permission from the parties in question, there should be no problem.
