he asked if he could use 4thed rules (smoke, etc.)
whats the thought? should this be allowed?
PS: I enjoyed the diversity, and it made for a chalange.

Keep in mind that Black Templars actually have a 4th edition codex, so certain items like Smoke Launchers and Storm Shields by the definitions in their codex don't work the same way as 'modern' codexes. For example, Black Templar and Dark Angels Smoke Launchers reduce all penetrating hits to glancing hits, not the 4+ cover save as per the newer codexes. This is perfectly legal.

It's actually how it's supposed to be played...wierdly enough.

This is a little story about four people named Everybody, Somebody, Anybody, and Nobody.
There was an important job to be done and Everybody was sure that Somebody would do it.
Anybody could have done it, but Nobody did it.
Somebody got angry about that because it was Everybody's job.
Everybody thought that Anybody could do it, but Nobody realized that Everybody wouldn't do it.
It ended up that Everybody blamed Somebody when Nobody did what Anybody could have done.

Don't mix rule sets. It will start getting confusing.
The 4th ed is a totally different story.
Beware of Falcons played according to the 4th ed rules.

Hmm... which is (statistically) the better option? At first glance I would guess the 50% chance to miss entirely.

If his codex defines smoke launchers differently, they use those rules (not the BRB).
If his codex says "refer brb" then they use brb rules.
Doesn't matter if it's a 3rd ed codex or 5th ed one.
DH have majik smoke that downgrades pen to glance (for a turn) and can use cover in addition for a 4+ cover save.
5th ed SM have one-shot cover saves (for a turn).

It is generally held that if someone want to use more updated rules(mostly BTs, DAs, and DHs wanting newer SM equipment rules) he needs to ask.
you are free to say no, BUT only if...
you are doing it because you don't think its proper for rules considerations
NOT just to be a Dick because you don't want BT terminators with 3++ saves.
Don't prevent someone from doing it just because you want to be a dick.
Don't be a Dick.

Giving my opponent a unwarranted advantage, I'd say that's a pretty good reason not to allow it. I'd also like my SM Scouts to have WS4/BS4 like Dark Angels scouts or be able to Outflank from any table edge like Space Wolves scouts, is my opponent now a Dick for not allowing this?

Maddening Mutant Boss of Chaos

Personally, in a friendly game I would ask my opponent if I could use a mix of Black Templars codex and c:sm with everything as up to date as possible (it would make it just more enjoyable) so instead of using 4th ed for old stuff, I'd make old stuff be 5th ed.
