I said it Clarified the issue, not fixed it

It didn't need fixing anyway, as the rules do not say you can use the opponents wargear. Thus, you cannot. It was only added because 90% of 40k players find following rules to be too hard.

They don't say you can't use your opponent's wargear, and if the unit meets the criteria for using the wargear (e.g. Necrons being Necrons being able to be teleported) then I'd assume that you can.

Yes, I am aware of the permissive rule set. This complies with it.
