ok what doesn't count ... scarabs, tomb spiders, pariahs and c'tan .... out of that only the C'tan really stick out as a good choice. Tomb spiders would be good to boost WBB and scarabs as a screen. But all of them enough to tip a game so you only have 10 warriors in reserve .. don't see that working ...

You are not required to field Monolith in order to keep warriors in reserves....5th allows any unit to start in reserves. Fielding a Monolith simply changes the way your reserves enter play.
Errrm, maybe because that is not what the rule says? It says if you do it they MUST emerge from the Monolith.
FAQ also says if they can't they can just walk on, but it depends on what you declare when you put them into reserves.

I think it's fair enough. Necrons aren't exactly high tier, so I kill all the necrons on the board, which should be an easy feat without a monolith to hinder me. I then sit on all the objectives until the game ends. You are still in reserve, so you are gone.
In other words, unless you heavily rely on non-phase out units, my killing of 74% of all phase out models on the board is crippling enough to end the game. If you are able to remove me with that 74% and whatever else you may have, you would be better off having the reserves in the open.
Also, surely when you roll for the necron warriors to come on, there will be no destroyed monolith on the field, so you will have to attempt to enter play, but will be unable to due to the codex rule, so you die.
Whatever happens, this loophole doesn't make anyone quake in their boots, but I suppose it's an interesting rules exercise. It's suitable for grinding the "Understanding Logic" skill.

Ah.
Fair game then. I'd say that roughly 26% of your army and the ability to take monoliths is a more than fair trade off for ignoring phase out.

You both phase out and don't phase out. Your opponent automatically wins but you still have to count objectives to see if he wins. Then your opponent packs up his models and goes for a drink.

now what if the necron army was like so...
2 necron lords with res orbs
 loads of necron warriors (with 25% in reserve)
then just walks them at u
is that a legal army where he can have all models on the field get back up on a 3+ and keep going and no phase out?
cause i really depend on phase out as my imperial gaurd and eldar.

This was never something that was intended and any avoidance by rules ; wording ; poorly or otherwise to break a rule that is fundamental and written specifically into the codex for the army is cheating.
So no you can't.

Cheating? no, to cheat you need to have a rule and not obey it.
Now back to this after looking at it you could easily do this while taking a monolith. Slightly higher risks of Phase out if your monolith is destroyed but ....
2 monoliths ... both in reserve turn 2 20/36 one will come in. next turn the other might ... basically you need 4 units of necron warriors in reserves and you stand good odds of them all not having arrived till turn 6.
You could also take a single monolith and 2-3 unit of warriors (4th unit will almost never arrive) but that's much more risky as you could lose a single monolith.
