I'm more interested as to why GenCon didn't institute a Foam Wars event.

There's money to be made there, I think.

I'm a little confused what Battlefoam is claiming here, based upon how this shook out.

My understanding is:

1.) A customer claimed to have Battefoam brand foam in SABOL brand bags. This foam was actually Outrider Hobby brand foam.

2.) The warstore was advertising Outrider Hobby brand foam, along with its compatability with SABOL brand bags, at Gencon.

3.) SABOL was issued a letter notifying it that Outrider Hobby brand foam may have some patent issues associated with it in the future.

Now, correct me if I'm wrong, but if SABOL wasn't trying to sell Outrider Hobby brand foam (thewarstore was), how are they liable for damages?

Unless I can't comprehend clearly written speech Squirrel is pretty clearly stating that they brought "display/promotional samples" not "sales product".

Aside from the politics surround this, I'm still really confused as to why this is a patent issue:

If Battlefoam has a patent complaint against Outrider, that's fine and well.

If Battlefoam feels they're worried that consumers are referring to non-Battlefoam brand foam as "Battlefoam", wouldn't that be under the perview of Trademark?

In all seriousness, i dont see how this makes warstore look bad.

Warstore has no track record of being nasty, the latter, has many snipes and PR issues.
