It wasn't "killed".

Basically: The guy approached Games Workshop asking for permission to compile the strips and sell them, for his own profit, as a hardbound collected volume.
Games Workshop told him no.

I think -roughly- a year later, the guy just decided to stop doing the strip.

It's not at all the same thing as having him shut down for IP infraction. All they did was deny him permission to make a profit off their IP... which they're well within their rights to do. Particularly if they are in the business of publishing books of their own, and like to choose just what gets published.

to be honest 'space marine' should be a generic term seeing as it was first coined by Robert A. Heinlein in misfit, not GW

Germany is not at all to blame for GW legal. No idea what you're basing that on.

Copyright has nothing to do with names. Trademarks cover names, in order to stop other people from using the same name in a similar context. It doesn't stop other people from using the name 'Space Marine'... it just stops them from using it in relation to something too similar to GW's Space Marines.

Actually, no. Most of EU is under Berne, however, some countries attach extra requirements to it. So, while GW would not lose their IP in England, it's conceivable that they might in some other countries. This would open the way to competion being permitted to produce 40k products, which is what has GW's undies in a bunch. I know that as IP is now considered a form of 'property' in some countries, some enterprising individuals have tried using abandoned property laws to try and have the government seize some IPs.

The German connection was to do with that film they wanted to release a few years back. Damnatus I think it was. Fan made flick.

I can't remember the exact details, but there's something odd in German copyrights law about if the film was released the fans would hold rights or something. So GW told them nope, can't release, and there was nerd rage on the internets.

Something like that anyways. I wasn't really paying attention.

The claim being made was that Germany is somehow responsible for GW legal acting the way they do. Given that GW legal have been actively enforcing their IP for decades now, it's unlikely that Damnatus was the reason for it unless there was some sort of freaky time-travel situation involved.

Mattieu~~~~ It's not that eldar are bad, it's that they require a lot of intergration between units. Also, that doesnt prove anything other than GW has a huge hard-on for marines, and, given the option between making a xeno the best psykers or making a marine the best psyker, they will 9 times out of 10 choose the marine.

Actually, Disney has been successfully sued in the past, such Luxo vs Disney when Disney started selling knock offs of Luxos lamp designs. And were dumb enough to actually call it the Luxo Jr.

It was never killed, as such. The creator just wasn't allowed to make money off it, since it was GW's intellectual property. So it became not worth his time.

As has been said by others, I've got this perception from a 'regurgitation' of what happened to Damnatus; the WU didn't exactly have much to say about that.

And yes, we dwell on a merry island. I'd chastise you for going OT with your geographic commentaries but it is indeed wonderful.
