As far as I understand it (through multiple discussions here, please correct me if I'm wrong):
1. Unit is shot, and falls back (for whatever reason). RP counters are removed.
2. Cryptek stands up (due to EL) within 3" of the counter (assuming he unit was 6" or more away).
3. Unit continues to fall back and tries to restore coherency so they can (possibly) attempt to rally.

In fact, the mere act of opening the box will determine the state of the cat, although in this case there were three determinate states the cat could be in: these being Alive, Dead, and Bloody Furious.

2, as above. The counter moves with the unit, as it is simply a note of how many models need to roll.
Language arguments really do work, as the book is written in English.

Ok, I think I was getting confused with EL after the entire unit is wiped.
Also in regards to what's-his-name (not trying to be offensive but using iPod and cannot check and type) hfh specifically states that you place a counter next to the marked unit. Are you trying to tell us that since your warriors fell back and "all counters are removed" you are no longer marked?

Ok, so it seems that the proper way to play it is this:
Cryptek gets back up and re-joins the unit that was falling back. Since the unit is now 4 out of 7, they would have been able to take the LD test to regroup.

Unless he is still out of coherency, A unit that is not in coherency cannot attempt to regroup ( BRB pg 46).

RP would've placed him back in coherency at the end of the opponent's assault phase as all tests are taken at the end of the phase. Thus, come the necron's movement phase, he is already with the unit and can test for regroup.
At least that's how I think it is played, though I don't have my codex with me right now.

Really? You claim to understand the English language but can't seem to grasp the basic concept of context. The counters/markers referenced in discussing falling back are in reference to the counters/markers in the previous SENTENCE of the RP rule, not all the counters in the universe.

... That is exactly nos's argument. That the reference to counters in the RP rules only refers to RP counters. Perhaps you should read the thread?

I think RAI, Everliving is an enhancement to Reanimation Protocols that simply allows the character to reanimate even when normal Necrons cannot. The distinction between EL counters and RP counters is one of the ways they do that. Reading the WD battle report, it is clear that if a squad is wiped out, the EL counter is not removed even though the RP counters are. Falling back is the same, RP counters are removed, the EL is not. Assuming the squad is not swept, the character then reanimates in coherency with the squad. In this case, RAW seems to support it as well (luckily)
And to avoid confusion, if the squad is swept, then the character must reanimate within 3" of the EL counter (the only Necron counter I can think of that physical location of the counter matters).
