Avatar 720 wrote:It IS a threat. "Do you want to take this outside?" Is a widely known phrase used when one party wants to fight the other, there is no other way of viewing it; that phrase is a threat in that in this circumstance, he implies that should the other party wish to continue the discussion, that it be in a phsyical fight.
To me, or most other people, it would be seen as a threat of violence, that would carried out if we continued to argue our case.
You also can penalise people for being intimidating, or is it okay if I stand over you, cracking my knuckles and asking if you really want to perform that game-winning move or not?
A threat is saying "I am going to do something harmful to you".
"Would you like to step outside?" says "Would you like to fight about this?" The thought of fighting may be intimidating to someone, but it's not a direct offer of harm, thus not a threat. Following comments may become threatening, but "would you like to step outside?" isn't.

"Would you like to fight about this?" is threatening, since it heavily suggests that the party saying it will get violent should the argument continue. An indirect threat is still a threat.

It was already put together, however it was just the bare gray metal so I didn't need to put any paint remover on it. The damn thing is really sturdy to, have not had a piece break off at all yet, I would have to call my friend and ask him. If I may ask, what makes the damn things so rare? I mean, I love the damn Titan, it's cool looking and it keeps my dog away from my models but damn, I have had so many people offer to buy it.

Ain't worth it, I usually phrase it something like, "Ok learning moment for me, 'insert question about rule here'." and that usually is met with "OH CRAP! Whoops shoudn't have done that" or with them filling me in on a rule that I forgot or misinterpretted.
No point in getting in someones face if you thing they broke a rule, just be casual about it and have fun.

No, it's intimidating. Not threatening. He hasn't directly offered to harm you. He might, once you refuse his offer of a fight, and then it would be threatening, but at the point he says 'would you like to step outside' it's not.
Further, if you were to step outside and he were to kick your ass, he would likely not be charged with assault, as you have tacitly agreed to fight him, making the fight what is referred to in law as an 'amicable contest', and implying your own consent in the matter.

I don't know about anyone else, but the times I've said "You wanna step outside?" has always been a threat of physical violence. You can argue any way you want, "he didn't SAY he wanted to hurt the guy", etc...you're either just that naive or you're trolling if you think otherwise.
I get rules lawyers, I totally do. Wanting to make sure that your opponent doesn't make a mistake in his favor, through misunderstanding/confusion or blatant cheating, isn't a bad thing. In tournaments there's something to be won, usually something that's worth thousands of dollars, (or not, could be a certificate of how awesome you are! Whatever.) so that rules-lawyer part is amplified by everyone playing.
Refusing to come to some sort of agreement over a game...well, that's just silly. Children stomp their feet and demand a recount, grown men suck it up and come to some sort of accord, and besides this gak shouldn't have happened anyway. The TO's should've been called, a resolution would have been given and everything would've gone on normally.
Note: The OP was vague in his description so the rules-lawyer cat could've been way out of line with how he was 'yelling over the rules'. The threat could've been justified.

Not at all. I really don't see how this is so hard to grasp. You even made the astute observation that saying "I'm going to go and get my gun" is a threat. He is directly offering to fetch a gun and shoot the other person. There is a direct offer of harm there.
Offering to step outside with someone is not. You're giving them the option. And you're not giving them the option of 'do you want an asswhooping?' you're asking them to partake a physical confrontation. Maybe thats what they're into. Maybe they would like to step outside and wreck some face. But just asking if that's what they'd like to do is not a threat. You'll never see or hear of anyone being charged with any threat-related offences for using those words.
If you refuse, they may become threatening. Or they may shut up. Who knows? But the question itself is not a threat, no matter how intimidated you might be by it.

Erm, no, you cannot have it both ways.
Where exactly in the phrase "I'm going to get my gun." does it say he will shoot you with it?
Just like "Do you want to step outside?" is an indirect threat, so to is "I'm going to get my gun." and you have just proven that by assuming that he's going to shoot you, and calling it a threat, despite those words never being said.
There is no direct offer of harm in "I'm going to get my gun.", yet you argue it is a threat, just like how there is no direct offer of harm in "Do you want to take this outside?", which you do not see as a threat.
Neither quote offers direct harm, instead both offer it indirectly, however you cannot have one being a threat and one not.

It's an implied threat. We can re-word it to say "I'm going to get my gun, and shoot you". Thats a direct offer of harm. That meaning can reasonably be inferred from the sentence.
The only meaning that can be reasonably inferred from 'want to take it outside?' is 'would you like to fight about this?' Which is quite obviously completely different to 'I'm going to shoot you'.
He's not saying he's going to beat you right then and there. He's not threatening to drag you outside and beat you. He's not saying that continuing the behaviour in question will result in you being beaten then and there, or being dragged outside and beaten.
He has stopped just short of threatening you. He has only asked if you'd like to fight. That may intimidate you, but it's not a threat. Automatically Appended Next Post: Think of it this way: If he goes to get his gun, what might happen? He might come back with it and shoot you.
If he walks outside, what might happen? Well unless you follow him, nothing.
See the difference?

Erm, no, you cannot have it both ways.
Where exactly in the phrase "I'm going to get my gun." does it say he will shoot you with it?
It's an implied threat. We can re-word it to say "I'm going to get my gun, and shoot you". Thats a direct offer of harm. That meaning can reasonably be inferred from the sentence.
The same applies to "Do you want to take this outside?". It's implied until you re-word it to say "Do you want to take this outside, so we can fight about it?"
I don't see your point here.
Kaldor wrote:There is no direct offer of harm in "I'm going to get my gun.", yet you argue it is a threat, just like how there is no direct offer of harm in "Do you want to take this outside?", which you do not see as a threat.
Neither quote offers direct harm, instead both offer it indirectly, however you cannot have one being a threat and one not.
No, that is not the only meaning, it is what you are portraying as the only meaning. You are missing that "Do you want to take this outside?" can be very reasonably, and is most commonly, taken as meaning "If you carry on this argument, there's going to be a fight.". Just because the indirect threat was in a question format does not mean that the implication must also be a question. If you say "Yes." then you go and have a fight, if you say "No." then you can expect to be met by a reply of "So you accept that i'm right, then?", to which if you answer "No." brings you back to the "Do you want to take this outside?" scenario.
The only way out is to accept he is right, or to fight him, if you say "No." initially, he won't say "Okay then." and carry on the debate, he will take it as your accepting defeat.

Him walking outside is not the point, if you agree to take it outside then he won't simply walk out and wait like you're assuming he will, he will wait for you to follow him. You cannot agree to take it outside and then not go, since that brings up back to the above circular discussion where your reluctance implies your defeat.

Or he might come back and show you how shiny it is, or he might not come back, or he might come back and hand you the gun, or you could be gone when he gets back... You're assuming that I will come back and shoot you, meaning it's a threat. If he walks outside, what might happen? Well unless you follow him, nothing.
Yes, and you can either a) camp in place for ever or b) step outside and see what he meant. I'm assuming you mean you want to start a fight because someone is annoying you over plastic toy soldiers. If I refuse, how am I supposed to figure out you're rational enough to not throw a punch right there? Just because you haven't already? See the difference?
Perhaps down under the culture is such that there's a difference. Most places, however, there isn't. edit: I'm not sure if this is funny or sad - back in high school (over 15 years ago) someone in my gym class took offense at a "your mom" joke I said (not even to him), and said, "I'm going to meet you after school." Teacher overheard him, took him to the office, and the last thing I heard him say was "I was just going to ask to hear the joke again so I could write it down!" Yeah, right. Trying to justify a threat by throwing out an unlikely scenario doesn't work.

My point is that two different things are being implied. One is that someone is going to shoot you, the other is that they want to know if you'd like to fight.
Do you consider the two to be analogous.
Hell, you brought the point up.
No, that is not the only meaning, it is what you are portraying as the only meaning. You are missing that "Do you want to take this outside?" can be very reasonably, and is most commonly, taken as meaning "If you carry on this argument, there's going to be a fight."
That meaning cannot be reasonably inferred from those words. He would need to say or do something else to imply that.

It is entirely the point. If he follows through on the implied action, what will happen? In the case of a threat, then you will be harmed. In the case of 'want to take it outside' then nothing happens. There is no 'agreeing' to it. 'agreeing' to is is completely irrelevant. If I don't 'agree' to a guy saying he's going to get his gun, he can still go and get it, and he can still shoot me. Thats what makes it a threat. The offer of harm. The "I'm going to do something, and it's going to harm you".
If a guy asks me if I want to take it outside, and I don't agree, then the worst that can happen is he goes outside and waits for me to change my mind. Thats not a threat.
He needs to say or do something else to make it a threat.

While it is off topic, I agree with kaldor. Asking someone if "they want to take this outside" will not in any court hold up as a legal threat. Saying you are going to get your gun however can very well end up with you in jail even if you didn't even leave to go get it. SIMPLY MENTIONING a lethal weapon will end with you in jail.
Even if you meant "im going to get my gun and show it to you" that will actually end with you in jail. So much as showing a lethal weapon to someone is legally considered a threat on their life.

It's actually not a lethal threat to mention a gun, especially if you can legally carry it. And speaking as someone who has been part of a situation where someone was arrested for threatening to step outside, I'm pretty sure you're wrong about it not being a legal threat. (charges were dropped, but not because of legal reasons)
It's a threat - saying it isn't is just trying to justify violence.
Oh, and the "amicable contest" thing is also bogus. If you're arguing that the intent can be non-violent, but start swinging when we step outside, I'll argue that I intended to finish the argument where we weren't bothering as many people. So you hitting me is assault.
It's either a threat of violence or it's not. You can't argue both ways.
Edit: respecting the gun scenario - it's illegal to brandish a weapon in a threatening manner. It's not illegal for me to bring it in in it's case, open the case, show the pretty pink handguards, etc.

The step outside comment is only a threat if the person it is addressed to is a minor, as there is nothing illegal about two consenting adults fighting provided both consent to it. Unfortunately you cannot charge someone with Assault - Threaten Bodily Harm with a "would you like to step outside" comment, provided that was all he said. So no this is not a threat, but instead a simple question of would you like to fight.
I am unsure as to the US but here a comment of "I am going to get my gun" is a threaten bodily harm if said in the context described. You can try to argue that you were implying you wanted to show someone you were arguing with your gun but you would be doing it in cuffs from the back of a cruiser.

And you can try and argue that I was consenting to a fight, but in reality I was going outside to minimize the disturbance our argument was having.
You can't have it both ways - if the statement was essentially "I'm going to fight you if you don't back down" that's a threat. Saying that I'm agreeing to a fight by stepping outside is the same thing as saying that the statement is threatening to fight.
Hence, it's a threat.

Mate I am telling you if I tried to arrest you for Threaten bodily harm on that it would not hold up, its not a threat, your asking a guy if he would like to fight you, while this may be bullying and intimidation unless its your spouse or a minor there is nothing wrong with that question. Your not saying you are going to fight him and he has no choice in the matter, he can just say no.
If you go outside this doesn't give him carte blanche to fight you either, you have the right to say stop at any tine. Before any fight or during, and if the other person does not it becomes a strait assault.

And he doesn't have to be there if/when I come back with a gun.
Canada might be different. But saying "Meh, it's not a threat, let it go: - especially in the context of the situation - doesn't fly.

Asking someone if they want to take it outside is considered Assault in every jurisdiction of the US.

To me, or most other people, it would be seen as a threat of violence, that would carried out if we continued to argue our case.
You also can penalise people for being intimidating, or is it okay if I stand over you, cracking my knuckles and asking if you really want to perform that game-winning move or not?
It isn't a threat.
In Australia (the 'convict country') it simply means you don't want to make a scene in public so everyone else can still keep playing.
Saying you're going to get your gun is the same as saying I'm going to go get a tank, you don't mention it unless you intend physical harm with it (or as a bluff), why would you need a gun besides self-defence (and if it IS self-defence, you'd simply say 'if you keep this behavior up mate you're forcing me to go get my gun').
If you said it to your wife during an argument because you didn't want your kids to hear, is that also threatening your wife, or is it because you don't want to make a scene?

I know it's not considered assault in any jurisdiction in Australia. It's also not considered threatening, for legal purposes.

But that wasn't the statement. That can not reasonably be inferred from 'want to take it outside?'
