New York its just "Menacing". New York State Penal Code Article 120, requires an actual injury, to count as "Assault".
Just saying it's not so black and white, the law anyways. What this guy had in mind is much easier to figure out.

No - if you say that I can reasonably infer that you are going to start a fight unless I agree with you.
A fight is a reasonable inference from that statement. Your unwillingness to see that boggles my mind.

Good lord. ALL that can reasonably be inferred from that statement is that IF you agree to 'step outside' that a fight will ensue.
It is NOT reasonable to infer that he will flip the table over and start beating you right then and there. Further statements or actions would be required for that to be a reasonable inference.

"Menacing" is assault.
The thing you say is assault is legally "Battery".
Assault is making someone fear they are in physical danger. Battery is actually doing something.

If New York had a Battery law that be ture. As they don't, it's classifed different.
