Because RAI and common sense say that the FAQ shouldn't apply to seeker missiles with skyfire (since the Tau codex, which the FAQ is for, doesn't contain any). Unless you're one of those people who insists on playing RAW no matter how stupid it is, in which case have fun being unable to shoot or assault with any model that is wearing a helmet.

I understand that. RAI I would play it that way too.
But he said if he was at a tournament as a judge. If you were shown that clearly worded statement then how could you justify ruling against it?
