In fact, the mere act of opening the box will determine the state of the cat, although in this case there were three determinate states the cat could be in: these being Alive, Dead, and Bloody Furious.

Doesn't matter, to prevent a necron from getting back up (in normal games) you have to make his squad flee.
or replace the model (with a daemon spawn or trazyn the infinite)
Or wipe the squad (provided they don't have EL like a royal court disco dance inferno list)
