IIRC all the holes in the lower to accept a M16 fire control group were present save one, and you'd need only a shim, thus - readily convertible.

Not by my definition of "readily" convertible.

I would basically have to buy the entire gun separately to make that into a gun. In addition, as I recall from the video the ATF agent specifically mentioned the gun's little pin which shot the BBs down the barrel could set off a real round, which was found to be false as I also recall.

In 2013 (most recent figures) 5 Police Officers were slain by rifles of all types, not just AR15 derivatives. In the same time period 2 Federal Agents were killed "with firearms" (no breakdown given as to type of firearm).
The figures given were just 5 LEOs killed with any type of rifle, and 2 Federal Agents killed with firearms. So it seems unlikely that all 7 law enforcement personnel were killed using both an AR15, and one firing M855 rounds. Even if we accept that the 5 LEOs were killed with the M855 round that figure stands against the 765,000 sworn officers in the United States.

No doubt, but the only part of the gun that matters is the lower, legally speaking.

I wonder if it would be possible to build a gun that didn't have a lower, that then technically wouldn't be a gun.

It's not always the lower.

For example, the FN Scar's upper is considered the firearm. Not its lower. Which is opposite to the AR.
