Roberto was the defacto leader of the Imperium at that point due to the size of the Ultra Marines.

If he had pressed the issue, the High Lords wouldn't have done a thing about it.

Painted armies:

Orks: 11000 points
Marines: 9500 points
Khorne Marines: 2500 points
Khorne Demons: 1500 points

That would have been treason. The High Lords were in command. It's part of why the traitors were so bitter; civilians were running what they had spilt blood to take. Without the Emperor and Malcador the next in command were the High Lords not the Space Marines or the Primarchs.

The high lords would have done whatever Roberto suggested. He was essentially the only thing keeping everything together at that point.

He could have reformed the legions in any number of ways.

Naw, that's mutiny, not treason. You'd have to turn against the emperor himself for it to be treason. Or help out the Eldar or something wword like that.

The High Lords rule in the Emperor's stead, they divine the Emperor's will and speak with the Emperor's voice. Turning against them is turning against the Emperor.

Not really. For instance, you can turn against some of the high lords and not others, since they are rarely in unanimous agreement. Is that treason? No. If you are not aiding or abetting the enemies of the imperium, it's mutiny, not treason.
