You could try having "soft cover" grant a -1 to hit penalty, and hard cover grant a -1 to hit and a bonus to the save - the difference between concealment and cover. 
That is awesome.
This is genius. Consider it stolen/adopted.

You can only target an enemy character if it is the closest target AND within 6" of of a friendly unit that is NOT in close combat.

Aircraft cannot be targeted by flamers unless they are hovering. All aircraft do not suffer the effect of -1 to bs when shooting heavy weapons, unless they moved whilst in hover mode. Jump units cannot charge a flyer unless it is in hover mode. Super Sonic Aircraft suffer -1 to bs when shooting all ground targets.
As a pilot the current aircraft rules make me so angry i don't even use aircraft.

Regarding the cover conversation, my group really want cover and unit positioning to be a key factor in our games. However, as stated above, to hit modifiers seem to penalise certain factions more than others. With that in mind, I wondered about the following which turns things on their head a little, and penalises you for being caught in the open. (The existing cover rules would also remain in play)
A unit which performs a shooting attack on an enemy in the open may re-roll all hit rolls of one. If any other ability already allows 1s to be re-rolled, then any dice which fail to hit may be re-rolled.
Would this be too much?

That might work. It also implies that being in cover is the normal state, which is appropriate.
As for the flyer rules, I’d add a rule that some weapons (e.g. flamers) cannot target FLYing VEHICLES unless those targets also HOVER. Anything more is just papering over the oddity of the rules for flyers. Just replace them wholesale with the rules from Epic Armageddon.

I essentially just ported over the terrain rules from bolt action. It had an immediate and overwhelmingly positive effect on our games.
Dense terrain: blocks line of sight through terrain.
Soft cover: -1to hit
Hard cover: -1 to hit and +1 to saves.
Difficult ground: halve your movement
Etc....

House rule here is we do not play Codex vs Index but once a Codex drops you cannot play Index only. 8th 40k is Mothball Edition.

The difference, for those who aren't aware, is that you explain "house rules" to your opponent ahead of time, ask them if it's okay, and listen to their feedback on what you've changed. "Gaming the system" is when you write and implement house rules in bad faith (without explaining them fully, without asking, without iterating to take into account other peoples' feedback, as a mechanism for list-tailoring...).
