Is it a documentary? They and some others are usually exempt from classification.

No, its a horror film. The cover has an 18 rating but there is nothing on the disc.

For a movie to get rated by the MPAA it has to be submitted. I can't think of any movie that was widely released in theaters that wasn't submitted. Direct to DVD movies; however; have no intention of ever being in a theater so the makers occasionally don't bother submitting them to the MPAA. They either make up their own rating or don't bother showing one at all. I think the only restriction is that they can't use the MPAA logo.

Since your flag is British I assume you are referring to the BBFC logo and registration information.
According to this it should be on the disc label as well as the package.

I had a look on e-bay for the film and there are two for sale that show the disc, both are missing the rating symbol. Does this make them collectable? (Similar to the UK 20p coin without a date?)

Its 'government' in that it has power of law behind it. In the same way TV licensing has.

It's not government, in that tomorow Richard Branson could set up 'Virgin Tight Ass Classifications' and go in direct competition with the BBFC as a regulator of films and videos.
My right to clamp someone parked on my lawn does not make me government.

The BBFC is a quasi-autonomous non-governmental organisation (a semi-statutory body) authorised by the Video Recordings Acts 1984 and amendments since, blah blah blah to examine and classify video recordings for sale in the UK.
It is illegal to sell non-exempt video recordings in the UK which have not been examined and registered by the BBFC. Such items can be seized by Trading Standards Officers and the police can prosecute the retailer. Retailers can also be prosecuted for selling recordings to underage customers.
