Hello,
Yes there are alot of them lately, I notice them most on Rackam minis, and Armorcast titans. There is one individual who strangly enough has a new Armorcast titan every month, with your choice of weapons, wrong color of resin as well. Bad thisng is he does not offer a discount of any type

Truly unfortunate the IT company was hit with the IP hammer. Im sure this chap would sell some models but hes asking too much. As far as recasting goes when does it become ok when a model is oop and really a colectable? For example what if I want a armorcast warhound or a phantom titan. Is it really that bad to buy a recast to play with?

Hello,
Actually if the item is intellectual property and copyrighted it takes a long time before your allowed to make recasts without the express permission of the owner of said property. Literary, musical works (+lyrics), dramatic works (+music), pantomime, dance, choreographic works, pictirial, graphic and sculptural works, motionpictures, audiovisual recordings, sound recordings, architectural works software, "mask works" of semiconductors, music videos, designs are all protected for the life of the creator +70 years.
Now your asking if it is okay if you want one?  Of course it ok to want one, but to buy one your taking taking money that could be had by the owner to make new nifty things, and preventing him or her from getting credit that they deserve as well. As for the Armorcast titans, I have no idea  how that would work as it is a licenced product that had its licence removed, and being that item was a copy of GWs epic scale items and the rights to those items were paid for by GW employing of the original sculptors. That being said, I don't think Ebay really cares  , and if Armorcast or GW doesn't either then meh. However your not in trouble for buying it, as you did no wrong I think, and only those at the GW stores are going to complain as its not FW titan.

Keep in mind, of course, that this is how it works in the US. Your mileage may vary.

its pretty much the same in britain, the only exception is peter pan, as Great Ormond Street Hospital have near pepetual rights over it, in the uk at least.

Yep, it's just in the Uk. I remember the fight when Alan Moor's 'Lost Girls' hardcover GN came out. Of course, since Alan could care less about the money, he just asked to have the coming out party for the UK edition at the hospital and donate all the proceeds from the UK sales of the book to them. And suddenly they were just fine with him using Wendy in the story.)
On a similar note, Uncensored Mouse was reprints of 50+ year old Mickey Mouse cartoons, that are public domain in the UK, but not in the US. Disney couldn't do much about the comic if it had been in the UK, in the US however, the swarm of lawyers that descended on them blackened the skies.

yer they don't have the power to stop the characters being used, they just have the right to royalties, but you got to think that any company that is trying to stop a childrens charity from getting some money is gonna look pretty bad to customers.
