Q2: can a painboss take ANY wargear besides what it sais he is equipped with on his page?

any help would be great

Yes. He swaps his choppa for the one, and his slugga for the other.

Can a who?

Yes and yes(sorta).

Painboyz can take warbike, bosspole, wagggh banner, ect but cannot take a power klaw, kombi weapons, big choppa, ect. Since he doesnt have a slugga or choppa, he cant replace them with any of the war gear that says to replace x with y.

I've heard it argued that since a Painboy is no no longer a Nob he may not take any of the upgrades available to them, I wouldn't have a problem playing it as Taoofss has stated but some people may.

Painboy can have a warbike(as the entire unit upgrades to that)

But not anything else, here's why:

Nobz have permission to buy the additional equipment, Painboyz do not. People often turn to the FAQ ruling of Purchase Order to justify giving the Nob additional gear before upgrading him to a Painboy. This conclusion is not supported by the purchase order ruling(although switching out Slugga/Choppa for different weapons is supported it is pointless as you then do not gain Dok's tools and Urty Syringe as you replace both for both). If you were to invoke Purchase order to upgrade a nob with say boss pole and heavy armor, then upgrade him to a painboy your net result would still be a painboy with wargear he has no permission to carry.

That you -can- carry it is permission enough. There's no rule telling you when/what items a particular model may use, outside of their unit entry.

A bosspole isn't a "Nob only item." It is just a piece of wargear.

The only "permission" you need to use/carry a piece of wargear is the ability to take the item, and a lack of prohibition on its use.

It's "their wargear".

It has always been my understanding that, as the Painboy has a seperate list of wargear options from the nobs, he can not take any options that do not say "the entire Mob may..." also, as far as an order of purchase, i have always gone straight down the list, as in: NOB A will i make him a painboy? Y/N Will i give him a power claw? Y/N...

True you require no permission to Carry/Use; but you do require permission to Purchase; and a painboy has no permission to purchase any of those options. A Nob purchasing those options and then upgrading still leads to the outcome of a "painboy" purchasing those options. the State of Being has changed and the altered state of being is not allowed to purchase the items that were purchased for it.

The same would be true if your parents purchased Ride tickets to a kiddy-park(a Children's amusement park) for you while you were under 48" tall(let's say you were 46" tall). The Kiddie-park does not allow children over 48" tall to ride the rides. You hit a growth-spurt a short time before you got a chance to actually go to the kiddie-park and grew 3"(so you are now 49" tall). Your State of Being has changed and you are now ineligible to ride any rides in the Kiddie-park(this is a bad example but the concept is relative).

Your example perfectly illustrates my point-- the tickets are only available to those under 48". At the time of purchase (which is the ONLY time the requirement is mentioned), the child -is- under 48" (i.e., the Painboy -is- a nob when you make the selection). In your example, the child might have trouble using the tickets, but you've already granted that there's no additional onus on a model to show permission for using wargear outside of the ability to purchase it.

The only things a nob gives up to become a painboy are his slugga and choppa- anything else he gets to keep, as the rules make no provisions for "stripping" him of anything that's been purchased at the time he becomes a painboy.

The most important thing to remember is that a painboy replaces his slugga and choppa with dok's tools and 'urty syringe. That means he MUST have a slugga and choppa to legally upgrade into a painboy. Therefore you cannot replace his wargear before he is upgraded to a painboy or else he no longer will have the slugga/choppa required to become a painboy.

So in short: A painboy cannot take any upgrade that would replace his slugga or choppa.

Edit: Actually, let me rephrase that. You can technically still upgrade your Nob to a Painboy, but unless he has a slugga and choppa to replace then you aren't getting the dok's tools & 'ury syringe...so there would effectively be no point.
