A common soldier can execute anyone if they turn and run... he might get in trouble but he can do it.
Officers would be questioned about it but a trooper might just be killed regardless.

But in all seriousness, if I saw the officer charged with keeping me in line and fighting running and screaming I would assume that the trouble was far too much for us to handle and would follow him.

Actually that's not true. You're right on the first one, but even if another commissar suspected them or was an eye-witness to their cowardice, it would still go to trial. Otherwise:

IG codex specifically says they don't. The Lord Commissar doesn't even shoot lower ranking commissars.

Commissars rarely run away, they rarely shot Guardsman to ( in the 41'st millennium even Guardsman life is starting to have value ). In most cases, commissars die on the front, surrounded by their fellow solders. But as always there are exceptions. Like that commissar bunch in "Fifteen Hours" who retreated to bunker and didn't came out ever since. But then I read "Fire and Honor" comic and saw a commissar hold a Regimental banner even when his entire insides are blown up by Tau commander.

Anyway, on OP - I think that Guardsman shoot him, quietly. Like Catachans...
