Note: I don't play it this way.

Rereading how crushing claws is written, couldn't it be argued that a carnifex who charged would get 5 attacks at initive 3 and D3 attacks at initive 1?

No, where are you reading that? It says it gains D3 extra attacks, and strikes at I1.

So no all attacks at I1.

No, if you upgrade a model with crushing claws, all of its attacks will strike at I1 from then on, no matter what

It's easier to understand if you break the complex sentence down into simple sentences:

A tyranid with crushing claws gains an extra D3 attacks in close combat.

A tyranid with crushing claws strikes at initiative 1.

Trying to say otherwise is shifting the subject of the sentence from 'Tyranid' to 'attacks', which is incorrect. The subject is always 'tyranid', so that is the thing that should be affected by the rest of the sentence.

No matter what Old One Eye has.

Think of it like this deadshot: does a marine with a powerfist strike at I2 if he has furious charge? No, he always strikes at I1 because of the powerfist.

Different wargear in this case, but same deal

Sounds almost like a servo harness but not quite. I feel as It's RAI for them to be done at diferent initiatives, however RAW they flopped bigtime.

OOE has living battering ram because he is a carnifex. No other reason - its called consistency.

Why do you think "RAI" they shouod strike at different I? There is absolutely no indicator of this anywhere in any text.
