If you have a Shas El with Battlesuits forming a retinue, that unit then takes over 50% damage leaving just the Shas El left, who fails morale. Can the Shas El regroup or not? I say no because HIS unit has taken 50% damage and failed morale (that's why he is falling back) or else I.C would just regroup and rejoin another unit.

By RaW, it is up to interpretation.

There are two situation the model can either:
Become an IC immediately, and not suffer the effects from the unit it was part of
Or the model becomes an IC at the end of the phase and so suffers the negative effects of his unit being destroyed, but can later regroup.

I'd be of the opinion that the IC would make the original test as if he was still part of the unit, but then immediately after would become an IC. From then on he would be able to regroup as normal if falling back as he would become a unit of 1 model.

But couldn't you say he cannot make said test because his unit is under 50%?

We did a dice roll off and I won it, I guess it didn't matter as that I.C would have ate splinter cannons next turn anyway.

Have a quick re-read of the retinue section of the independent character rules. The rules state you revert back to an IC if the retinue dies so from that point he would become a unit of 1 so could rally as normal. The only rules problem is when this change occurs and so whether the original morale test would apply to him at all.

Yes, as he is still part of a unit until the end of his next movement phase.

Note that if he took drones as well, his original unit size was 1 - 3, so if he took 2 drones, losing both he would be below 50% of his original unit size and therefore entirely unable to rally

Indeed he was Nos. The unit was Shas El, drone and bodyguard. I killed the latter two.
