Reading rules for Swooping Flying monstrous creatures (p49) I came across what seems to be a rule loophole, with RAW working contrary to what was intended.
Under Grounded Tests third paragraph , lines 5 down, read:
"A grounded Flying monstrous creature can be charged in the following Assault phase and automatically loses the Jink special rule (if it had it), but can move normally in it's next turn."
It DOES NOT say that Flying monstrous creature looses Hard to Hit rule it gained for swooping in it's last movement phase.
What do you make of this?

Yes, currently, not only that but since it's still swooping it can be grounded by the next unit that shoots it.

Somewhere over the rainbow, way up high

I would say it was intended to mean it can move as a grounded monsterous creature next turn, as opposed to a flyer?

Under the current rule i find it is far easier to kill FMC when swooping. The grounded check is every hit. So 20 bolter shots are far more effective at a swooping T6 than a regular T6. The ground hit is nasty. Just need a 6 to hit then its a 1/3 chance of crash. Much easier then 3+ to hit, 6 to wound then they get to make a save.

It's one grounded test per unit that hits. Not per hit. Massive difference.
