List #1 is better because it's got more troops....but it still isn't all that great.
Too many deathmarks. I'd rather bulk up on the troops than on these guys. Also, you've got too many non-essential crypteks. You can probably trim them down. Also, give your night scythe to your troops. Finally, try to get a command barge for your Overlord so that he will be useful. You can drop the Semipatenal Weave on him if you do so to save 15pts.

I second everything the above poster has said. You've gone over board with the court but its still going to do better because you've got more troops.
You should note that with squads of troops that small, that aren't in Scythes or Arks, you can look forward to being torn apart far too quickly for anyone's liking. You really should mount them up.
The above comment on death marks is spot on as well, they just aren't worth it. They look cool and have some fancy rules but they don't preform as they should do in practice. I'd say drop these and get some more Scythes or more wraiths.
For the HQs, as I've already said, there are too many useless members of that court that don't mix well. As per the FaQ you can only take one of every cryptek per Royal Court, and only one court per Overlord, so at most you can have two of the same Cryptek. Too many of the Necron players I know refuse to play by this fact though, so you can probably make it by. If you do take more than one of the same Cryptek I would take the Harbinger of Destruction, not the highly situational Storm.
Ontop of that, your overlord has no unit where he can work well with, and so that warrants a command barge, which you've neglected to take. So you'll probably have to pick that up to make it of any use.
To put it simply, I choose the first list out of the two, but neither is optimised. Good luck!

Thanks for the feedback I went with the first list. It was the final round for road to the NOVA invitational and I came up one game short. Lost on the final table by an incredibly slim margin. I have to say that the Deathmarks were dominating most of the day. They provide a guaranteed assassination squad.
jy2 - I have not had much luck with the CCB in 6th. It is just difficult to utilize the sweeping attack. I live your max threat overload but the average troop did most of the work for me today. Seems like survivability is the name of the game in 6th and Necron Immortals excel in this regard. Especially if you put an Overlord in front and back him up with a chronotek.

Congrats on your performance.
Yeah, the CCB got nerfed slightly in 6E. However, I still like it because of its 30" movement. It adds another credible threat that the opponent just cannot ignore and draws a large amount of enemy firepower. But if you don't use it, that's fine. It isn't an auto-include in every list.
I agree that troops are more important now more than ever. And necron troops have actually improved due to glancing gauss, so it doesn't really hurt to take more of them.
A lot of playing is by trial and error to see what works for you and what doesn't. Eventually you will fine-tune your army to where you are comfortable with. And most importantly, do it with the units you like and not necessarily the ones that everyone say that you should use.

CCB is still a beast, IMO. It draws a TON of fire, but I move mine from cover to cover until I can engage targets. The CCB should take out tac squads or basically things that aren't TH/ SS terminators. 12" sweep, 2 S5 AP3 shots, d6 S6 HoW attacks, and 4 warscythe attacks off of the charge.
As far as night scythes, put gauss immortals or warriors in them. They should engage in rapid fire to kill as much as possible. Tesla Immortals need to stay at range.

That is not true. Only the wargear after the Harbinger upgrade is unique and 1 can be taken per court. It's completely fine to have 5 Harbingers of Destruction in a Royal Court, however you can only have one Solar Pulse or Veil of Darkness per court.
