Hello
During today’s battle, we came upon a tricky question: how is cover (line of sight) is measured for Flying monstrous creatures in Swooping mode?
Lets consider a winged Hive Tyrant (like this http://www.dakkadakka.com/wiki/en/Image:yakTyrant1) or Bloodthirster (3-4” high), Swooping and positioned behind 5” high wall. On one hand, True line of sight (p8) would RAW mean it is out of sight and thus cannot be targeted. On the other hand, the creature is considered to be high above the battlefield (and thus cannot be assaulted or burned with flamer) and thus shouldn’t be able to hide behind 5” wall. Rules for Flying monstrous creatures on p 49 do not mention such situations so technically there is nothing to stop them from taking cover. Heck, there is nothing RAW that would stop them from getting cover save for being partially obscured by intervening units on foot!

Nothing changes in regards to FMCs and LoS. You still use TLoS and if the model is completely out of sight you cannot target it.

Fluff-wise, it is flying in front of the sun so the unit trying to see it are blinded.

Greebo had spent an irritating two minutes in that box. Technically, a cat locked in a box may be alive or it may be dead. You never know until you look. In fact, the mere act of opening the box will determine the state of the cat, although in this case there were three determinate states the cat could be in: these being Alive, Dead, and Bloody Furious.
Orks always ride in single file to hide their strength and numbers.

What Happyjew meant by flying in front of the Sun, he means, flying through the smoke and rubble of the battlefield. But other wise he is correct

As tyranid player, I should be happy that my flyrants are getting cover saves, but it just feels soooooo wrong .
Not charging with outflanking genestealers feels wrong too though,
So i guess the wrongnesses will have to cancel each other out i guess

Or house-rule them. I know I'm getting a flying stand for my FMC's...

I'm 12years into the hobby, nd it's getting quirkier and quirkier with every edition...

Now that sounds like a plan

Don't think of it as them flying high in the sky, think of them flying quickly through the battlefield.

Very hard to hit something flying through a bunch of terrain at breakneck speeds, even when you thought you hit it, sometimes you hit intervening buildings/trees.
