Could they even or would they be insta-killed?

Depends on what you mean by CSM. Renegade Marines can return to Imperial service if they're discreet enough. There's a bit in the Deathwatch RPG about Blackshields (I believe that was the name), Marines who serve in the Deathwatch without revealing their Chapter or their history. It implies that it's a way for an excommunicate Marine to return quietly to the Imperium, though I think they typically serve out the rest of their life in the Deathwatch.

However, if the Marine has actually been tainted by the Ruinous Powers, I think they're pretty much screwed. Not only would the Imperium not accept them, they wouldn't be able to serve it loyally even if they wanted to because their corruption allows the relevant Chaos God to control their actions at times.

That isn't really up for debate either... the omniscient narration of Legion and the other novels makes it clear enough that Allpharius and the Alpha Legion was actively working against the loyalist legions, their reasons be damned.

I think in the DA books (codex) some of the fallen have repented and tried to make amends by rejoining imperial society and using their abilities of leadership and martial prowess to promote the IoM. At least until the DA catch up to them, then its off to the torture chamber.

And Magnus used his sorcery for the Emperor and humanity when warning of Horus' betrayal, we all saw how that worked out. It doesn't matter what Alpharius' intentions were, the Emperor is rarely depicted as a forgiving person so Alpharius is a traitor.

I read a short story in one of the old anthologies about a Dark Angel who got stranded in space before the heresy and floated around in Stasis for a long time and woke up in the eye of terror where he met one of the Fallen who told him that Horus had won and the emperor was dead, so consequently he dedicated himself to Khorne.

Afterwards he realised his mistake and tried to rejoin the DA but I think they just executed him.

Not exactly a CSM rejoining his chapter, but I remember, years ago, reading a short strory where a daemon tried to corrupt a Space Marine and a Sister of Battle. The Sister resisted, while the Marine fell and went on to be a feared Chaos champion. Years later, the Inquisition had the Sister (now a Canoness, or some other high rank) seek out the Marine and try to make him repent. She successfully made him see the error of his ways and I think he blew himself up.

Like said, I read it a long time ago, but that was the basic plot. A few details could be incorrect.

I'm not aware of any known ones, but I am REALLY hoping that Cypher is the first.

Love his story, and a fitting end would be to bring some of The Fallen back to the Imperial fold.

I love Cypher too, and I just hope that the rumours of him reappearing in an allies codex at some point are true.

It's a real shame he didn't make the cut for Dark Vengeance or the CSM codex.

Well, Cy is a mysterious dude. No one knows if he works for KAYOSS or for the EMPRAH. The GW site suggest to use what you want, the CSM or DA codex. The problem is: you must use a Captain/Chaos Lord profile... so, yeah, not enough for a badass like him.

I think I read this same story, eventually the Angels take him back to the rock and I think he doesn't get tortured they just execute him because he autorepents... but I could have sworn in that same story a Fallen is tortured, repents, and then somehow ends up back on the Angels side... but that was many years and many ounces (liquid and non-liquid varieties if you catch my drift) ago, so I'm probably wrong.

Without giving away any spoilers, the story is about a Grey Knight who pushes the envelope of loyality.
