He has been out of touch via email with me and other clients for sometime, for me over 3 months, for others, going on 8.. He during that time has used many excuses or just silence. He claimed he was deployed then he claims he was just busy.

All during that time he was posting on various forums, the links I sent included. All the while ignoring me and others that he owes models and/or money.

He did good work for others as well but in the end, he just screwed us all over."

You might be able to identify Steven by his armies. Steven doesn't play 40k as much as he used to, but still plays on occasion. He has a very distinctive Tyranid army that looks like this:

I know Steve and he's a really good guy. I know locally he's dropped off the radar gaming wise, but then so have I so that may not be accurate. I will see if I can find a way to contact him and point him to this thread. He's a good guy and I think he'd work to make things right here.

While I haven't actually met Steve, I know he used to be apart of my local gaming stores core group here in Voorhees. I've seen him every so often, though I don't know him very well. I think the last time I saw him was earlier this month. Unfortunately I can't find him in our communities fb group. I'll look him up again and hit him up for you if possible.

Voodoo Boyz and Stoupe, that's very helpful. I was going to comment the same- I live in MD but there's a fair bit of wargaming folks who know each other well from DC / MD / eastern PA / NJ, as it's all so close together. Particularly with the army pics posted above, it's likely he occasionally attends events.

Talking to him in-person and pointing him to this thread would be helpful for him, and the OP, in getting this resolved... obviously having your name known in the local gaming scene (and beyond) as someone who is extremely delinquent and out of communication on a commission is not something anyone wants. Hopefully it will spur him to fulfill his agreement, or at the very least make reparations.

UPDATE: I got a package today from Steven with all my minis. Some of them are broken/missing pieces. Most are assembled, but none have been painted like we agreed. Steven did some work on the models, so I think he deserves to keep some of the cash I sent him. I sent him 375, and I think he deserves 100, so I would like 275 back via paypal.

Are you saying he just now shipped them back without communicating at all since June?

And so basically, now you have the models back, but not the commission fee. When you say he "did some work" do you mean they're basecoated, or what? It would be great to see pics of what you received back.

I took some unboxing shots of what Steven sent me. Everything was packed in shambles, and some of the minis were broken/had missing parts. Obviously a rush job.

It looks like steven did some basing, and assembled most of the models, but as I mentioned before, nothing was painted. I am being generous when I say he did about 100 dollars of work, and I expect to get the remainder of the 375 dollars I sent him back.

Yeah, that is crazy... He needs to refund some of the money and you are more than reasonable as he breached contract, he should return all of it in most business agreements unless there were pre-discussed milestones.

At least you got your models back.

Happy you got your stuff back, I've seen many other cases such as this where the buyer wasn't as fortunate.

I'd definitely ask for a full refund however. Otherwise, you'll have just paid him $100 to hold your stuff for a few months.

I would definitely ask for a full refund, otherwise you've essentially paid him $100 to glue your models together and break some of them.
Looking at how they were packed, I'm amazed any of them were in one piece.

If you are looking for a refund there are two ways that I would attempt to go about it.

1) I would contact Paypal and file a complaint. They should be able to get you a full refund.

2) You could also contact the US Postal Service and file a complaint of postal fraud since he shipped the items with them and conducted an interstate transaction without any intent of satisfying you as a customer.

I would attempt Option 1 first but if necessary Option 2 will work the only issue is that there may be some federal charges attached as well.

Haha, nice. I don't know what got in to Steven which made him start acting flakey. Whatever it is, he needs to fix it. As of now, he still has not gotten back to me about. I guess he wants to keep my money.

Paypal puts a time limit on disputes, usually 45 days after the transaction. Unfortunately that has passed, so I would have to go the postal fraud complaint route. Has anyone had any experience filing a complaint on that note? How long does it take the feds to act, and do you end up getting any of your money back?

Thanks for the update. Mailing a check is something I haven't seen used for payment in some time- you paid him by Paypal, and he could do so instantly (with no chance of it getting lost, or supposedly getting lost, etc...). You can set up Paypal to draw directly from your checking account, and thus act just like sending a check would.

So, hopefully this is good news, but I would withhold judgement until you actually have the check and/or it clears...
