You're telling me that the Blood Angels winged teardrop artwork is something that you personally designed?

That's BS, and you know it.

That is a Copyrighted GW design that you knowingly infringed for commercial gain.

he got permission to put it on there...

not to mention that someone asked for the Blood Angels winged teardrop on their case?

OK, show me where he got permission from GW.

I can ask you to murder someone. If you do so, it's still breaking the law.

Show me that he did not get permission.....

Nice Creationist-style reply.

Too bad I don't actually have to prove anything. You see, according to GW Legal (and American Copyright law), without explicit permission or license, using their logos is an actual IP violation.

OTOH, to be a legit business, BattleFoam *musy* be able to demonstrate that their use is non-infringing, and to date, Romeo has ducked this point at least 3 times. It's almost like he's got something to hide...

Unlike Mr. Wade, Romeo hasn't been threatened to be sued by an outside entity.

Point 1 if it is the process that is patented and this process uses cutting lasers,[ and he is being accused of breaking a patent] then this foam corps fellow went and spent 6-7k just to copy BF?

Point 2 if he did not use a laser (his cuts do not look clean) and the process patented uses a laser then how is he in violation of going against a patent?

point 3 if foam corp purchased a foam tray to try to "reverse engineer" the tech. Then that means he produced this foam without inside info on the patented process? So he figured out from one tray what it took 2 years to perfect?

I am sorry, but from what I have seen so far this does not make sense. This guys foam does not have the quality that BF so how is it bootleg. If he was using the same patented process then wouldnt his product be the same quality? If BF knows that this guy is not using their proces then taking legal action against foam corp just looks like they are trying to bully a competitor out of business. I hope no one takes any of the above as an attack, but there is just alot of info flying around that does not make logical sense. Hope you folks can clear it up.

Point 1.

Laser cutters cost over $30,000. Mr. Wade does not own a laser, he had been renting time on one.

John's point is that Romeo should be able to easily show that he has GW's permission to use their IP (which legally he must have)...

and my point asking for a patent number or proof that he has applied for a patent is silly as there is no way Battlefoam going to put something like that up.

its like asking someone for their bank account number when they say they have one.... there not going to tell you their account number unless you have a good reason to do it.

Also, when you sign into contracts or deals into IP rights and contracts usually there NDA involved and would be unprofessional to even show to make some net guy happy.

Heh. Wrong. Not even close on this one. He makes it, he sells it, if GW wants to tell him to stop, he'll have to stop.

How long does this need to go on for? Its been solved hasnt it? He gets permission for the cuts. It appears as though he has no lisence to put on everything but as long as he is getting permission he can keep doing his job... If GW says no... then he stops... Based on what Ive read this is the case... why make it more confusing and take low blows at people?

All you need to be afraid of is being proven a liar.

If you want to make a RL claim about me, then say who you are, rather hiding as some random guy who claims to know me, but can't put up when challenged.

It does when you claim to know somebody RL.

You know that a BF patent has absolutely nothing to do with having GW authorization to use their IP, and that raising BF IP is nothing but a poor smokescreen for a lack of argument?

Wow, i don't think I have seen so much absolute crap talked about a topic that very few people have real knowledge about.

Time to let it go and the two foam people sort it out themselves and GW to deal with them as it sees fit.

BTW, just to add my own uniformed comment that has just hit me, isn't it trademark infringment by using BA on the foam ONLY if BA is a registered trade mark. Nothing to do with IP.

Is there anyone who actual knows the difference and cares enough to answer?

2014 will be the year of zero GW purchases. Kneadite instead of GS, no paints or models. 2014 will be the year I finally make the move to military models and away from miniature games.

Wow, I know this is discussion of IP but I recall back when Romeo at BF introduced gamers to BF. He became a god and 80% (okay maybe slightly lower) of dakkaites were praising him like a saint and more or less kissing his ass.

Now someone decides to start a smear campaign to make Romeo look like a thief and the pitchforks and shotguns come out and he is defending his product against dakka and against another foam maker, who quite frankly, suck at making foam trays.

Wow, just wow.

Nerds sure are fickle people.

--The whole concept of government granted and government regulated 'permits' and the accompanying government mandate for government approved firearms 'training' prior to being blessed by government with the privilege to carry arms in a government approved and regulated manner, flies directly in the face of the fundamental right to keep and bear arms.

“The Constitution is not an instrument for the government to restrain the people, it is an instrument for the people to restrain the government.”
