Have you ever been on a field trip? Kids bring home a stack of papers, and at least one of them is a liability waiver. That, or the parents sign one at the beginning of the year that covers later trips.
And free speech does cover insensitive speech, as the teacher was put on leave. As for the Stars and bars, ignorance is not an excuse for offense once informed of the meaning of the offending event. If I were to eat pork in front of someone who was vegetarian, told me of their beliefs and asked me to stop because it offended their beliefs, if I were to continue eating that goes from being unaware of the event to being aware and rude.
