I assumed that's what he was referring to as well, but I just wanted to point out that the actual cost isn't actually zero.

Well you pay tax wherever you live, so it's better if you actually get some benefit from it.


That's true, but in some places (like in Europe) you pay a lot more taxes than in others. It's a tradeoff. I agree that if someone is paying as much in taxes as many people do in Europe, they'd better be getting something out of it. I would want to get something out of it. In the U.S., people benefit from paying taxes too, but they generally don't pay as much so they don't get things like nationalized healthcare.

I'd suggest talking to a lawyer who'd be willing to help you bring a lawsuit against an 11 year old kid. That would probably be the best place to start.

I get that. It doesn't mean that she and everyone else wouldn't still be paying for it though. Depending on what kind of insurance you have (or what income bracket you're in, or what hospital you went to), someone in the US might not have been presented with a bill either (or alternatively be presented with a bill that they wouldn't have to pay out of pocket for).

She's also seeking an unspecified amount for pain and suffering, so she might have still had a basis for a some sort of suit.

I think it's a pretty hard argument to make that she has a (non-ridiculous) basis for a suit against an 11 year old for anything, regardless of how much her medical bills are.

Surely the possibility of getting hit by a ball is just an associated risk with going to a ball game?! Ergo, if you don't want to take the minuscule risk, don't go to a ball game. Where the feth is it going to end? Are they going to have to put "WARNING THE COFFEE IS HOT" signs like you get on Macdonalds cups outside of stadiums? "There are balls at ball games, we cannot take personal responsibility if you get hit by one yadda yadda"

I mean, I even think the warnings on hot drinks cups are stupid, because feth me.. all sorts of mental things COULD happen when you are a human, are we going to have to start putting signs on everything?!

"Warning, if you jam knives into your toaster you can get electrocuted"

"Warning, if you put your cat/hamster/dog in this oven it will die"

"Warning, if you pick this apple up and bang it against your wrist very hard for a few hours you could get a bruise"

I could think of ten things that COULD go wrong about any product/event you can name, why don't we put enormous lists on everything?

This type of gak makes me furious. And it spreads, give it a couple of years and some British chav will be in the news, trying to sue someone for going to a nudist beach and getting offended because she saw some balls.

People need to start getting punished for frivolous law suits, alls they should do is, make a rule so that you can try and sue anyone for anything, but if you fail and the judge decides that your lawsuit was unwarranted you have to give the person you tried to sue your house. Problem solved!

Anyone in any legal system in the world can file a suit. The system is only at fault when such lawsuits get up and win, and they almost never do.

The bigger issue is with the exploitative culture that you can sue for stupid stuff and win, and with the lawyers who take their cases on for them.

It's actually worth reading about that case. It's a lot less ridiculous than it first sounds, and when you realise how little the plaintiff originally asked for, the only ones who come out badly are the lawyers for McDonalds.

Except most people haven't actually read the details of the case, and just assume 'coffee is hot' and that's that. The coffee served to the woman was a great deal hotter than what anyone would reasonably expect... as in 'a few seconds of contact gave her third degree burns to her genitals' kind of hot.

There is an acceptance of risk when you buy coffee or go to a baseball game, but that acceptance of risk only goes so far. So injury from a typically hot cup of coffee is on the plaintiff, but not the excessively hot coffee that McDonalds was serving. In the same way this woman ought to consider a stray baseball a reasonable risk of attending the game, but not so if, say there was a new bonus round in which players threw balls at the crowd and scored a run for every person they hit.

Or something. I'm willing to accept my analogy above was quite silly.

But the injured person wouldn't have had to pay, and so wouldn't have had to seek recompense from anyone else involved in the accident. Which means the cost of legal representation and any time taken up in the court wouldn't be suffered in the English system.

This is one of the administrative efficiencies of a government healthcare system.

Except US government expenditure on health is not that much less than in Europe. The US, in fact, spends a lot more government money per capita on healthcare than Germany. It's just that US healthcare, because of the various inefficiencies of its 'worst of public, worst of private' system has outrageously expensive healthcare overall, and so even though government piles in a lot of money you still end up with a hefty bill at the end.

I was playing rugby in college, and being a 5'9 6-7 I'm generally advised to not kick the ball. One game our 15 got hurt and our only subs were other pack players, so being the only decently fast guy they could replace I got cycled back to fullback; this meant kicking. On the first kick I hit the sir in the back, the second knocked over our water jug, and the third dented the quarter on our coach's BMW which happened to be just over the fence on the East side of the field. He was pissed, and then he realized he should have just pushed our 11 back to 15, and put me at 11.

Warning labels are there because people do stupid stuff, Take this warning label for example:

You know at some point someone put their kid in there and closed the lid, then when the kid was injured they wanted to sue the company.

People can be so stupid sometimes.

This lady was at a baseball game. you know what else is at a baseball game? Baseballs that can be hit into the stands and hurt you. (Or thrown)

You have got to watch out for them, if one hits you it is your own fault. the same goes for baseball bats. they sometiles slip out of the batters hands and land in the seats.

Lost in a blizzard, somewhere near Toronto

I recall years ago when my Bantam AA hockey team went to a tournament in the States...

There were so many "WARNING! 'X' could happen!' signs all over the arena itself, our parents could barely make-out the action on the ice!
The change rooms were even more plastered, with warning about everything from "locking your dressing room isn't 100% theft-proof", to "hot water in showers can burn."

We laughed alot that weekend at just how many stupid a s there really are out there!
