You guys give me crap every time I mention that stupid people need to be sterilized/destroyed. This woman validates my point. She needs to never be allowed to reproduce-her offspring could end up as dumb as she is. She offers nothing to the community other than being the source of a juicy mob. That lawsuit wasn't really that frivolous... it just sounded like it. The woman only ever sued for the cost of the skin grafts that she required, as the coffee was served at 180 degrees, and resulted in 3rd degree burns. She admitted it was partially her own fault for driving with the cup in her lap, and only ever tried to claim partial responsibility from McDonald's.



This one, however, is absolutely ridiculous, and the foolishess of thinking that a jury would award damages is foolish.

I think most people think if you put a cup of hot coffee in your lap and it spills, then it's your fault if you get hot coffee on you. Hence the supposed frivolity of the suit.

In this case it seems ridiculous that someone should even dream of getting $150,000 from an 11-year old, let alone that they should think that the catcher in a game of baseball is responsible for a ball hitting a spectator. It would seem more reasonable that the thrower should be responsible.

I don't think I would call it frivolous so much as ridiculous.

That's what I was thinking, I thought you had to be 18 to sue someone or be sued. It's actually legal to sue an 11 year old? I figured I would read the article and she'd actually be suing the parents or something, but that's not how it sounds. If it's actually legal to sue an 11 year-old, that's horrendous.

You can understand suing an 11 year old kid? The woman is a freak. I'm not saying she deserved to get hit by a baseball, I'm sure it sucked and I'm sorry an accident happened to her, but bringing a $150,000 lawsuit against a kid is monstrous. Accidents happen. I can barely believe that she can't be charged with some sort of child abuse for trying to ruin a kid's life because of an accident. She should be held in contempt for contributing to the continuing degradation of credibility in the American legal system.

If the kid had done it on purpose, I'd feel a bit different, but then he would probably be facing criminal charges and it wouldn't really matter. There are definitely situations where kids should be charged with crimes, that's what juvenile court is for, but I'm not sure there's ever a time when bringing a lawsuit against a kid would be appropriate (or anything other than completely pointless).

I would have thought that if you were to sue a minor the responsibility would pass onto to the guardians wouldn't it? By that I mean they'd be the ones out of pocket for it, not the minor themself.

If I am reading the article correctly I think he was throwing the ball back to the pitcher.

I'd suggest talking to a lawyer who'd be willing to help you bring a lawsuit against an 11 year old kid. That would probably be the best place to start.
