I guess the problem lies in what was once a chanced glance, coupled with circumstance, is now immortalised by the photograph. Upskirts are a little different though as nobody is at that eye level 99.99% of the time.

People have been dressing to impress forever.
The point about the upskirt shot is that the woman didn't put her panties on display, the man involved deliberately contrived a way of looking at what was intended to remain hidden. This is no different really to drilling a hole between the mens and womens changing rooms at a gymnasium.

Its not insane at all. There's a concept in the law here that, judges have to follow what the law says. Its an amazing concept.
Looks like Mass already voted to modify the law appropriately. Move along, nothing to see here.
