So the new Militarum Tempestus start collecting box came out, and within it came the attached formation.

The Formation states "Commissar" as one of the unit types.

My question is as follows: Can this Commissar be upgraded to a LORD COMMISSAR, as in their profile within the MT Codex it allows you to, and I quote, "Upgrade the Commissar to a Lord Commissar for 45 pts."?

I am under the impression, as this is an upgrade (similar to war gear, etc) that you could upgrade him, as the base profile is still that of the commissar, just upgraded. There is no singular LORD COMMISSAR unit for the army.

Thoughts?

(Attached Formation rules, and Commissar rules-- which clearly state a LORD COMMISSAR under "Unit Composition: Commissar")

I'd treat it the same as the chapter master in a demo company - yes.

Similar to the use of a Chapter Master in a Demi-Company (i.e. a "Captain" is required, but a Captain has the option of being upgraded). Answered in the GW's draft FAQ is "Yes, you can do that, but it's not what we meant." - fluffwise a Captain is what's meant to be leading a demi.

Here, however, the formation is much less based on strict company-level doctrine, so I think it's probably fine.

I don't see why you would be allowed swap the model with an other model with an other name.

Just looked at the codex and you are right.
I expected it to be an other datasheet but lords are just an upgrade for Tempestus commisars.

Just one sanity check: the Hellrain Brigade does have the Tempestus Scions Faction and not the Astra Militarum one, right?
Because AM commissars are definitely separate dataslates to their Lord commissars.

From the images i saw, the start collecting formation do not refer to a specific codex per se (no army simbol just the formation one) unless there is one in the other side of the card, and seems to allow the use of any codex with the proper entry.

As example Start collecting skiitari, comes with models belonging to 2x different codex skiitari and cult mechanicus.
