If a unit who cannot harm something CHOOSE to fail their moral check are they still subject to a sweeping advance attempt?
E.g. 40 gaurdsman are charged by a tomb stalker and cannot inflict any damage so choose to fail their moral check after combat is resolved with the above rule. Can the stalker perform a SA and potentially kill them all?

Definitely.
I like it as a tactic for Codex: Space Marines to actually use Chapter Tactics usefully. Even if the marines are caught, they're not wiped out. If they get away they auto-Rally the next turn (no 6" enemy unit rule to run them off the table anymore) and proceed to shoot whatever was attacking them in melee. I particularly like it for use against Dreads, Soul Grinders and the like. Sure, you can eat a few bolter dudes, but if I escape I've got some melta for you on my shooting phase!

but marines have krak grenades, so they can hurt dreads and thus cannot choose to run away with our weapons are useless. Can they auto fail a break test or just calgar?

@ Exergy: Unless you play a captain that exhanges [Combat Tactics] with [Chapter Tactics] then all non-vehicle Space Marine units may elect to automaticly fail ANY Morale test they are called upon to make and thus fall back (and auto regroup because of ATSKNF).
[Chapter Tactics] are Shrikes ability give the army fleet, Korros Khan's ability to give the army outflank etc.

I have a little hobby-thread going in the P&M section. Some say it's the best blog on Dakka, some don't agree, most belive it would be better if I finished at least one project some time this century and not just kept starting new ones.

They could be fighting something with AV 13 armor, like an ironclad dreadnought, in which case their weapons would indeed be useless.
