For the second week in a row, the Washington Healthplanfinder website is down, and it's causing problems for people who are dealing with billing issues. Some of them say the website is mistakenly debiting their accounts.

Shannon Bruner of Indianola logged on to her checking account Monday morning, and found she was almost 800 dollars in the negative.

“The first thing I thought was, ‘I got screwed,’” she said.

The Bruners enrolled for insurance on the Washington Healthplanfinder website, last October. They say they selected the bill pay date to be December 24th. Instead the Washington Healthplanfinder drafted the 835 dollar premium Monday.

Josh Bruner started his own business this year as an engineering recruiter. They said it’s forced them to pay a lot of attention to their bills and their bank accounts.

“Big knot in my gut because we're trying to keep it together,” said Shannon Bruner. “It's important to me that this kind of stuff doesn't happen.”

They're not alone.

One viewer emailed KING 5 saying, "They drafted my account this morning for a second time."

Another woman on Facebook with a similar problem commented, "We are all in the same boat."

“We've got to figure out how to get money to pay the bills for the next week or two until we have another check come through,” said Josh Bruner. “It's just crazy.”

Washington Healthplanfinder emailed the Bruners a few days ago telling them to log in to view their invoice, something they couldn't do because the website has been down. The Bruners haven't been able to get through on the helpline either. They finally contacted Healthplanfinder administrators by posting a message on their Facebook page.

Washington Healthplanfinder tells KING 5 their staff is looking into the problem.

Until it's resolved, the couple is putting their best face forward.

“We haven't bought anyone's Christmas gifts yet,” said Shannon Bruner. “We're just kind of waiting.”

“We wrote a check to our nanny last week, it isn't going to work,” said Josh Bruner. “So she can't get paid.”

The NY Federal Court spanked the government yesterday over the HHS Mandate.

TL;DR:
- This is the first litigation to result in a final injunction against the contraception mandate for religious non-profit organizations even though it may have qualified for the narrow religious exemption to the mandate. This is a HUGE distinction because it recognizes that even the act of having to claim the exemption is an unacceptable burden on religion.

- Jeebus... even the administration didn't really know what its proposed regulations do....

- It's obvious that the Obama administration doesn't take religious beliefs very seriously.

- The Judge even argued that the Obama administration has handed out so many exceptions to the law, it can no longer claim the law serves a compelling purpose. O.o.

- The Judge bacically reprimanded the Obama administration for thinking it has a general exception from complying with the Constitution. The government's defense kept pushing that they were legally obligated to push the HHS contraceptive mandate... which, the Judge stated that "argument makes no sense; in any challenge to the constitutionality of a federal law, the question is whether the federal government could adopt a less restrictive means, not any particular branch within it. It would set a dangerous precedent to hold that if the Executive Branch cannot act unilaterally, then there is no alternative solution. If defendants lack the required statutory authority, Congress may pass appropriate legislation."

EDIT:
There is a distinction that needs to be addressed here... The contraceptive mandate is not a “legislative mandate.” The PPACA was a legislative victory for the Democrats and Prez. Barack Obama, but the HHS contraception mandate has never passed Congress nor was it proposed as law.

This is simply a regulatory mandate since Congress (Democrats) lazily wrote a bill that granted the HHS these powers. This is one of the reasons why it's a gak sammich of a law in the first place.

My mind is blown that this administration doesn't seem to want to tweak this mandate to provide religious exemptions. o.O

If the exchange is able to replicate its best weekday and weekend performance during every one of the 104 days between now and the end of the open enrollment period on March 31, Maryland will still only achieve about three-quarters of its goal of signing up 150,000 people with private coverage. The site may be better, but better isn’t good enough.

Under those circumstances, the question raised by Rep. John Delaney, a Montgomery County Democrat, about whether it would be better for Maryland to scrap its effort to build its own exchange and instead join the federal one has merit. Indeed, Gov. Martin O’Malley acknowledged on Monday that the option — and all others — remain on the table.

That’s a hard possibility for Governor O’Malley to acknowledge. Under his leadership, Maryland was one of the most aggressive states in the effort to build out its own exchange — a strategic decision that appears in retrospect to have involved no small amount of hubris and political ambition. Walking away now from all that effort and tens of millions in expenditures would be particularly embarrassing.

It would also have policy implications. Maryland decided to build the kind of exchange it did because officials wanted to create something of a one-stop portal that would integrate shopping for private plans and enrolling in Medicaid…

The state also had designs on eventually integrating enrollment for other social services — like food stamps and energy assistance — into one system. Scrapping the state exchange altogether would ensure that none of that would be possible, at least not anytime soon…

…Both the governor and Lt. Gov. Anthony G. Brown indicated on Monday that they are open to all options. They need to be. We can’t let pride or momentum get in the way of doing whatever it takes to make sure Maryland residents can sign up for health insurance as soon as possible. After all, despite the political overtones, that’s what this is about.

But I will say that the exemption reflects an establishment of religion, which is (as far as I know) damn near impossible for anyone to claim in suit, and that it is is disgusting that a group so protected would dare to claim being treated otherwise is tantamount to discrimination.

If your religious belief is that abstinence is the only permissible form of contraception, surely mandating you to pay for all other forms of contraception could be considered as the government infringing on your beliefs? I'm sure you have some sort of law about that...

Might as well add, in what way is religion more protected than a lack of belief in the US?

Anyone can create a religion, and they are automatically tax exempt, but only the IRS can certify one as tax exempt if there is some dispute as to legal exempt status.

Which is problematic for a variety of reasons which I think are self evident. I reiterate that in my opinion religious organizations should not be tax exempt.
