Hey all, I have a question for anyone with an idea about UK consumer law, or the workings of the store known as "CEX"
I was in town the other evening, and a friend and I went into CEX to get a bad 80's action flick to kill a few hours watching.
In conversation about the trade-in prices, my friend said that he'd considered trying to trade in a Xbox 360 game that no longer worked (Skyrim, IIRC)
So, despite a bit of google-fu, I can't find anywhere that says that he would have a responsibility to ensure that a game works when you trade it in.
He said that as long as they took it, then he was golden, and that if it came to it, he'd claim that the game was working fine for him before trading in.
Dubious morality aside, does anyone know if this is something he could get away with?

He could probably do it. But they check games so unless it wasn't scratched or anything he'd probably not get away with it.

No, they check all traded in games first on an xbox they have in the back. Your friend is an idiot.

I would have to add a huge 'feth you' for trying.
Anyone buying that broken game will be justifiably pissed off. Trouble is 'doesnt work' covers many possibilities, from a heavily scratched disk, which Computer Exchange will detect to a few corrupted data cells which will likely not.
Computer Exchange cant load every disk and read all content on it, some errors occur in packages loaded in play. Someone buys a game plays it and then if fails on them.
Do they get to find out in time to return it under warranty?
You might not care, but its a serious inconvenience for an innocent third party.
If the disk is corrupted bin it, dont sell it.

No. They take your name and address on trade ins.

Well the staff at CEX check for scratches on the disc when you trade in. If your mate has a disc in bad condition then they won’t accept it.
They don't however do any checks on individual discs aside from this quick visual scan, they couldn’t play each disc even if they wanted to. It would take a disproportionate amount of time/money to do as hundreds of discs get traded in at each given branch on a daily basis. They only do more thorough checks on hardware.
If they accept the game, then they accept the game. If it turns out to be knackered later on there is nothing they can do, It's not like they are going to break down your door, it simply isn’t worth it. Besides I don’t think they label each individual disc with who precisely traded it in. The occasional disc that passes the ‘scratches test’ but is knackered anyway is just the cost of doing business.
That being said if your friends knows the disc isn’t fit for purpose but tries his luck anyway he is a dishonest little scrota and you should probably call him up on it.

These trade-in places often have a resurfacing machine handy, if that's the case then I wouldn't be surprised if they offered to take it but with a quid knocked off the original price.

Yeah, I told him it would be a dick move to trade in something that you KNOW doesn't work - I mean, if I bought a game there, I'd expect it to work.
I was just interested in the legal side of it

I imagine they have systems to deal with people who often trade in known defective stuff. You need to set up an account with them using ID, so it must be possible to get black listed.
Not that they offer much, anyway

I have a friend who is a manager of a CEX store, in his store they check the disks, and have been known to blacklist people who try to pass off dodgy stuff.

The trade-in store I know of over here seems to test everything: I saw them testing Megadrive (or Genesis for some) games.
