So as I am looking through the gallery, I am finding awesome models, but what are the rules and regs of making your own model?

There are no rules, but as a rule of thumb:
1. It should be approximately the same size as the official model.
2. If there is no official model, it should be of approximate size to a model with similar stats.
3. If your model looks friggin sweet, you will have fewer compalints.

In fact, the mere act of opening the box will determine the state of the cat, although in this case there were three determinate states the cat could be in: these being Alive, Dead, and Bloody Furious.

There are no rules that allow you to use anything other than the standard model, so the answer is whatever you and your opponent agree on. As a general rule the model will need to be roughly the same size and shape for LOS purposes and be WYSIWYG. If you follow this policy most people will be happy to allow your custom model.

My friend made his own riptide after being disappointed by the one that GW released. It has a lower profile than the GW one, but as he made it by hand, entirely out of clay (exceptions being the weapons) and it adheres to Happy's rule #3, he still haven't had anyone even mention it.
It's obvious he didn't make it the way it is to gain an advantage, but only because it looks frickin sweet, and people pick up on that.

Generally speaking its WYSIWYG, but the 'Rule of Cool' is much more important.
If you're just trying to save money, please don't.
On the other hand, an interesting/great conversion is greater to more players (not all) than an well/interestingly played game.

Making your own is no different to buying alt sculpts from elsewhere.
In rough order:
It is WYSIWYG?
Is it similar to the official model?
Is it better than the official model?
Whatever, does you opponent allow it?
GW should allow scratch-built, as long as a % of your army is using official parts.
