Oh yes. The $6000 the hospital says Eckert owes them? Gonna be small change to Eckert once he gets done suing the HELL out of the police department, the city said PD belongs to, and dropping a malpractice case that could sink the titanic on the medical center. Hell theoretically because his body was violated like that criminal charges could be involved too, not just civil liability.

With one hospital refusing, with the repeated invasive searches taking place outside the jurisdiction, and outside the time of the warrant any defense of acting under the warrant is null and void. Those involved in this sustained assault on a person should be punished to the full extent of the law.

Theoretically you could make arguments for rape and sexual assault. Vanilla assault is obvious.

And false imprisonment too if the warrant was invalid, this has the potential to open up a large legal can of worms so I could see a quick and very quiet settlement

Oh I hope not. Muwahahahahahahahah. I want this guy to walk away owning a small city, police department and a hospital. No lawyer taking this guy on as a client in his right mind is going to settle. All criminally and civilly liable parties (PD, hospital, etc) should be starting to realize that that cold sensation is there collective balls in a vice. The criminal case is BIG. False imprisonment, false arrest, abuse of police power, assault, harassment, illegal search/seizure, assault, etc. Once that's done, the massive violations of police and hospital procedure (for example the drug dog used hasn't gotten his yearly re-certification check since 2011, everything about the warrant, multiple non-consensual invasive medical procedures including the application of anesthesia (holy gak) etc ad nauseum) + pain and suffering on the part of our victim means, you guessed it! A civil liability suit AND a medical malpractice suit that each resemble giant monsters about to beat the ever living feth out of Tokyo.

Yeah, sniffer dogs aren't that reliable. They have a massive rate of false positives.

The idea that on the basis of one sniffer dog positive, these idiots could just keep putting fingers in the guy's ass is incredible.
