It doesn't have to be one or the other, it can be both. Drop pods are open topped so they are already assault vehicles. You cannot assault the turn you arrive from reserve though, so it doesn't matter much.

You should probably be a little more specific in your question... but generally since the Drop Pod rule is a more advanced rule than the Assault Vehicle rule, it would take precedent.
However, if you're trying to work out whether or not a Unit can assault after it comes out of a Drop Pod, the answer is no. Units can't assault the turn they come into play from Reserves.

Yes, assaulting on turn 1 w/ Lucius or Dread claw specifically. My friend is turning blue in the face right now lobbying for the assault.
This applies to infiltrating assault vehicles too, correct?

The Most recent Lucius pattern rules changed and no longer allow turn 1 assault. Instead, the unit inside (normally a dread) can stay inside the drop pod and assault out of it on turn 2. I have no idea about Dreadclaws.
The infiltrate rules are pretty specific about assaults. I don't have the rules on me now, but I'm almost certain the unit inside is considered to have been deployed via infiltration for the purposes of assaulting. Someone else will have to verify that though.

Yes, the rules say infiltrate/scout deployment restrict 1st turn assaults. Since the USR trump the basic rules, open top/assault vehicle rules are ancillary. Thanks for the support.
My CSM buddy thought he had a eureka moment with assault vehicles, hahaha.

"Assault Vehicle" allows for assaulting after a disembark move. It does nothing to lift the restriction for assaulting on the turn they arrive from Reserve.
Lucius Drop pods havn't allowed assaulting on the turn they arrive for some time now.

Tell your friend to just keep his assault units in the dreadclaw until it gets destroyed his opponent's turn and then assault. The whole time blasting units with the heat blast

Make sure the assault unit inside is fearless, though. Failing that pinning test when it gets wrecked is no fun.

The only thing being open topped does for a drop pod is add 1 to vehicle damage rolls. It would be better not having the rule
