Yup, that was a fun read.
Fault is with the OP, he should send the models back at his own expense and pay for the sellers postage by way of a reduced refund on reciept.
Sorry Akaiyou but looks like you're going to be the one taking the hit on this, think of it as a public service in educating others.
By the end of this saga plenty more people will have heard of AI.
Here's a google search for those interested in doing their research: https://www.google.co.uk/?gws_rd=ssl#q=Aeronautica+Imperialis

Oops. I voted on knowing about the existence of "Aeronautica Imperialis"... the book that talks about fliers and such for 40k, rather than as a separate game.
... but, be that as it may, if the OP did not know what he was buying and was just (as claimed on BT) "jumping on a deal that seemed too-good-to-be-true"... that's the OP's fault. Caveat Emptor and all that... and, also, should probably have done a bit of research. But, be that as it may, just about everyone knows that there have been plenty of spin-off products from the main wargame lines over the last 30 years... Gorka-Morka, Mordheim, the RPGs, Necromunda, Battlefleet: Gothic, etc.

Nope, that book is called Imperial Armour Aeronautica. http://www.forgeworld.co.uk/Warhammer-40000/Imperial_Armour_Books/IMPERIAL_ARMOUR_AERONAUTICA.html

No, sabotaging the poll would have been saying "Akayou thinks he's right and is hoping that X is correct" (note how I still didn't specify what answer you were looking for), but I already think you showed you were in an argument by asking people to hypothesize about what others know, rather than asking people what they know.

Akaiyou,
Unfortunately, it appears that you are in a situation many people find themselves in. All too often people see something that's "too good to be true", and then get shocked when it isn't. The way the world works is that, quite unfortunately, you have no recourse - it's the very definition of "Buyer Beware". Sorry buddy, I wish I had better news for you. I understand your frustration, as I've almost been caught by this myself. Someone had posted some fantastic looking deals, but the way it was posted made you seem that you were buying a whole army when in fact you were buying "random lots" broken up from the army pictured. Because I sat back and looked at things carefully, I spared myself the cash I would have lost.
But that's it! This guy may or may not have posted the items in good faith, but the reality is that this doesn't matter. Nothing explicitly said that these were the regular fliers for the game, and in fact he had all the information right there to show that they, in fact, were not. Legally he's totally protected, and that's even assuming he meant to dupe someone like you - which is something you can't prove here.
Sorry bud, but I had no idea what Aeronautica Imperialis was when I checked out this post, but as soon as I saw I would gain the Aeronautica Imperialis rulebook with the deal... that would have set off warning bells in my head that maybe I should research this further.

No sympathy from me, even IF the case was that he got the raw deal, which doesn't seem likely. A fool and his money are soon parted.
It's like... if you were walking across the street when you had the light, you would still look both ways to make sure traffic was stopped. Doesn't matter if you've got the right of way, you'll still be just as dead when that jerk who jumped the light bounces you off of his hood.

Akaiyou wrote:Was that really necessary? The fact that I made this thread neutral to preserve poll integrity has now been sabotaged by you sir. Good job.
"Poll integrity"??
To try to justify your lack of research on what you bought?
I feel so used...
The overall theme here is the OP has a rather scary lack of curiosity.
I must admit that when I was on the Forge World site I had spotted it right away when they were selling it (what the heck is that?.. ah! neat).
I would be pretty sure not to confuse a 6mm scale model from a 28mm in a picture unless that was some mighty fine painting on that 6mm.
"Aeronautica Imperialis" is an interesting term so I would think it would involve looking up.
Receive a box where you are "sure" you did not get what you ordered... you don't open it... really??
The incredible deal on pricing is beyond insane, it did not raise any questions?
I can feel sympathy for most people not getting what they wanted but in this case... the negligence in this matter is bordering on unforgiveable.

To start this off I should say that I am the seller in this "bumble####".
I do appreciate that, so far, this is 100% behind my side of this and that the majority of posts are civilized and constructive. I would ask though that any other comments are also kept civilized and non-insulting. If I'd screwed up I'd want to know, but it's hard to accept when it feels personal. I can only hope that if the OP sees enough constructive comments that he may finally be willing to accept his mistake.
I don't wish the guy any hurt, I just want what's fair.
Thanks all.

OP, stop being TFG and accept that you made a mistake. The sale thread explicitly said "Aeronautica Imperialis", the seller gave you pictures of the models that clearly showed they were Epic-scale, and you just didn't bother to do your research. You should consider yourself lucky that the seller is willing to give you a refund at all, if I was in their position I'd tell you to STFU and I'd keep the money.
Edit: and wow. OP wants a full refund before returning the models. I'm really not sure if the OP is honestly that clueless, or if they want a bunch of OOP AI stuff and figured out a great way to scam someone for it.
You know, at first I though the OP was probing the community -Dakka's one of the largest wargaming hubs after all- to see if it was worth contacting GW for a videogame license. My mind works in strange ways...

Odd poll, but voted. I reckon 25% would have heard of it or thereabouts. It wasn't that widely distributed being a FW only product, but it was well known to most Specialist Game players, especially if you play Epic. I love the game myself, got a fair few planes and a good number of fleets (though I am massive Epic fan anyway).

Hahaha, oh dear. I reckon OP is a bit thick and a quick google of Aeronautica Imperialis would have told him all he needs to know. Even asking the seller would have done it ("'ere, just to make sure, these are the Forgeworld models for 40k?" "Nah bud, these are for AI and are for the 6mm scale game of the same name"). As an aside, I'm always on the lookout for more Aeronautica Imperialis planes...

Well that was entertaining to read. Sorry OP, you booboo'd, keep the models or take a delivery fee. I've made more expensive mistakes then this. It happens. You learn to move on. Don't think of it as a fail but rather one of many steps it takes to becoming market savvy.

In an American court-drama the conversation would have gone like this:
- Attorney A; "How many Americans know about Aeronautica Imperialis?"
- Attorney B; "Objection, your Honour. Calls for speculation"
- Judge; "Sustained. Counsellor, please rephrase the question, and where are you going with this line of questioning?"
You done goofed, OP. Seller was clear about what he was selling.

The fact the OP tried to drag along that argument for that long is saddening.
Especially when he had 0 backers in the matter the whole time.
At Grav99 has everything got worked out yet or is it still underway?

Under paypal review awaiting decision. OP has twisted things around to paypal to try and get every penny back (I posted what was visible on the Btown report). I've sent in plenty to prove my case, so will just have to see which route paypal decides.
As a note though, he posted the claim as empty box, not "wrong items", and paypal is pretty happy that the box is not empty, so hopefully they just throw his claim out and make him return it for most of a refund.

Good luck. Hopefully this doesn't turn into one of those cases where the paypal employee doesn't know anything about the hobby and sides with the buyer by default. If they do you should report the OP and get them blacklisted from every trading site, this kind of fraudulent paypal claim can really destroy the trust that a trading community needs to function.

There is no such thing as a hobby without politics. "Leave politics at the door" is itself a political statement, an endorsement of the status quo and an attempt to silence dissenting voices. |
