The miniatures that I paint on commission have TAG under the base, the G having a stem, while the miniatures from my own collection have D13. (The 13 is actually a separated B - meant to be read either way.)

And I say that as a person who does commissions regularly.

Perhaps there is more detail we are missing here.

Now, I can say, if I sold some minis that I someone else had painted AND they were good, AND I knew who it was, I MIGHT mention the original painter, just in case the new owner wants to get more painted to match.

The only time I would considering reselling something I painted rude, was if they said someone else painted it.

I would never expect folks to even mention me, especially if they bought the minis off someone else, there would just be no way they could know ^^

Personally I think I would want to give credit to the painter assuming I knew who it was and that it was a reasonably impressive paint job. Not talking competition worthy, more like better than normal.

But if got something from user xdr3733 on ebay and don't even know if he is the person that actually painted, I'm not following up to see who actually painted it a year later when I sell the stuff.

Basically if it was commission so I know who did it, or if I'm impressed by the model and know who painted it, I probably give the painter his props.

I'm a little surprised by the prevailing attitude that once you hand it off the other guy has no reason to credit you. For me paint jobs are art and with art you should credit the artist when practical. Not hard to add a line "painted by Joe Smith" to the description.

I think what really miffed me was the guy using the gallery option on Coolmini or not, and then submitting pictures of my paintjobs. I feel like if you are going to be posting photos of minis on a site like that it should be your own work.

that is a completely valid argument, and it would upset me too...
placing an auction on eBay selling a painted mini bought off of an artist, or the original guy who commissioned it, or five owners down the road, without giving credit to the original painter doesn't seem like a big deal...
submitting them to the CMoN gallery when it is not your work, without crediting the painter, is basically claiming it as your work...

i get very pissed off when people put my images in their gallery without asking permission, or giving me credit for my work...
it has happened to me on a few occassions, and is not cool...
i totally understand your reaction on that one, beowulfhunter...

You have a legit issue here. Ebay has rules against it, in fact. You could've reported the auction because they were using images you owned the copyright to.
In your shoes I would have and, in fact, have done so in the past.

If he is using YOUR pictures of a mini YOU painted but he OWNS then you have a claim.

If he is using HIS pictures of a mini YOU painted but he OWNS then you do not have a claim.

CMoN FAQ:
The painter of the figure generally does not get any rights in the picture unless, of course, he took the picture. However, we endeavour to make sure all work is properly creditted and will act if someone is passing off another person's work as their own.


I know people are mad about uploading a mini to CMoN tries to take ownership of the paintjob, but that system is also a mechanism for selling painted figures. A well-painted mini which is trying to be sold has every right to be posted to CMoN even if the person has no idea who the original artist is. It is valid to have the mini voted on and even sold as an individual mini.

If you paint a mini, and you sell it, the paint job goes with it and you don't get to own how the paint job is displayed in the future. Your photos you can, other photos of a sold mini, GTFO.

Okay... but he had posted them there as part of trying to sell them, right? As long as he's not trying to claim the paintjob as his own work, there's no issue there.

Actually, that isn't true. Ebay has rules against using someone else's photographs for your auctions.

I don't think that the OP has ever said that the seller is using the OP's pictures - in fact he has complained that the pictures are poor.

The OP is complaining that the seller is using the OP's paintjob without credit, not the OP's photos without credit. (feel free to correct me if I'm mistaken)

I don't know why you are so upset about, you sold/relinquish the minis to someone else. Its not like they are entering a painting comp as their own or using your photos without permission. A none issue, this coming from an artist, former art professor.

If anything, you sound a bit petty. You should be proud that your minis are passed around about.

It was that the seller had them up in a gallery on CMoN, not that he was using anything the OP had done.

Here is the story, a guy is selling some painted minis. I painted them and he must be reselling them for someone else. First l am annoyed that he is using the auction gallery feature on a very well known painting gallery site...think hot or not if you get my drift.

No where does he mention that they are painted by someone else(although he does not claim to have painted them). What also makes me mad is that he does not even have good photos of the figures.

This is why people have been telling the OP he needs to untwist his shorts, because getting 'mad' because golly, someone is using the auction gallery to try and sell minis? Get the smelling salts, I do believe I'm suffering an attack of the vapors!

Especially since the OP even said that it seemed like someone else than who he painted the models for in the first place. You can't rationally find fault with someone who says, 'I'm selling some painted models. See these pictures."

No. Of course not. Where would this responsibility be written down? Would it be law? International law? Was a contract signed when the models were sold they if they were to be sold again, the painter's name must be included as part of the sale?

He bought the figures, they are his. He can spray paint them pink and claim king kong painted them for all he wants.

Maybe, if the paint job was great enough, saying who painted them could be a nice thing, or a selling point to increase the cost. But what if you sold him models painted one color? Would he be obligated to say you painted them then?

My only problem is if HE claimed to have painted them himself, possibly causing an issue with you on said well known site. I feel that would be a bad thing to do to you.

These are the deep questions that keep me up at night

I think he's saying is that the seller used his own pictures of the models that the OP painted (and that the seller bought/commissioned) - as opposed to reusing images that the OP actually photographed himself.

In which case there's no copyright issue whatsoever.

Property rights aside, the one case this might become important is if the models were lost or stolen.

The OP mentions the person selling the minis is not the original purchaser. In my experience, people tend to hang on to miniatures they pay to have painted (unless they really need some money.)

Might be a good idea to reach out to the person you sold them to and make sure he's okay with the sale.
