Suggestions? DMCA?

Do you mind them using the image? If you just want credit. Tell them you just want it noted. Most people don't want a headache copyright wise and its a pretty easy fix to just add "Photo courtesy of blah blah" to a web page.

Now if you don't want them using the image, It may get a little harder. You may have to prove ownership that it is your image and not dakka's. You also need to look into the photo posting ToS for dakka to make sure you do own it once it is posted. Most websites take claim of a photo once it is posted to them to use for their purposes whenever they choose.

I own the copyright. that's not really the issue. The issue is lack of credit if they're going to use it, I'm left basically leaving something in the comment section which means larry will probably just delete the comment. I'm not opposed to going the dmca route if I have to.

Sounds like you already are on the right track, I'd email the editor and let him know. Post on his google plus page if he wont respond. Plug yourself in the comments linking back to your gallery on dakka. Etc.

You might also ask for a slice of their (probably slim) ad revenue...

BoLS are, frankly, a bunch of spankers about this stuff. Several times a month I see people stating the same as you, that their image has been appropriated. All they have to do really is credit the image source clearly, and that would clear up most of the problems, but so far there hasn't been enough problems generated for them to actually care.

Typing "Battlefleet Gothic" into a Google Image search comes up with that very same picture as the very first picture of actual models (the first several pics are artwork). And it isn't linking to the one in your Dakka gallery but to a different website (although that other website does provide credit). That's probably how they got the image to begin with. A mistake on BoLS to not provide credit, but to not even give them a legitimate chance to correct their mistake before going the DMCA route may not be the best thing, either.

Understand, me letting them use the image with accreditation is up to me. This isn't fair use, they're not doing a story about my image or the fleet contained within.

And I said nothing, suggested, or implied, anything even remotely to that effect. Understand, my sole point in that statement was to indicate how incredibly easy it is to find that image outside of your gallery.

I would suggest giving them more than a half hour to respond, especially when it may be after business hours in their time zone. That's all. I understand there is a lot of dislike for BoLS. But I also believe in giving people a chance to acknowledge and correct their mistakes.

And I have said nothing remotely along the lines you seem to think I said. I did not suggest that it should be tolerated. I did not suggest that it should not be dealt with. What I said was to give them a chance to fix their mistake.

But I can see that my opinion is clearly not wanted here, so I will say no more on the matter. I do hope a satisfactory conclusion is reached.

No issues with your right. Just questioning your timing. Why post on BOLS at all if you weren't going to give them time to notice and correct the problem?

Interesting that they didn't just replace your image. They replaced all of them with stock images.

BoLS isn't The New York Times. They've probably got no idea where the images came from and changed them all to be on the safe side.

My image was specifically downloaded, re-named and uploaded to their host.

That doesn't mean they knew or cared where it came from. I imagine they just Googled BFG Fleet images, and grabbed the first one that looked nice.

I don't mean to condone this behaviour in the slightest, but it's remarkable how ignorant people can be about copyrights and so on.
