Subject: Fortifications - legality of taking a Fortification as a formation

Can an Aegis line be taken as a fortification formation - Battlescribe says yes.
Many Tau and now a chaos player are taking these as a formation in their lists. AT MY FLGS.
No one owns the stronghold and fortifications books (not even sure if thats what it's called). Everything, I think, is being dictated by battlescribe.
Is that legal?
Can you only take fortifications if they are in your detachment rules? Like the CAD?

Fortifications need a Fortification slot. Battlescribe is wrong in how it presents Fortifications, there is no "Fortification detachment". I believe they do this for coding reasons - this way Fortifications are in one place and not all over the place once something changes - so if the ADL gets buffed to 3+, the one maintaining the repository only has to change one line of code instead of once for every Faction available.
But BS does one thing correct: Fortifications are by default available to any faction. So yes, Tau or KDK may bring an Imperial Bastion or Aegis Defense Line - as long as they actually have a Fortification slot available, which, generally speaking, can only be a Combined Arms Detachment which has ONE of those. ADs don't, nor do normal Formations have one unless specifically mentioned. I think the Tau have a Formation which allows them to bring their Tidewall Fortification (which, by the way, is also available to anyone, but one or two Special Rules will only work for Tau IIRC)

The new Tau fortifications actually have the Tau Empire Faction icon on their datasheet. This makes them only available to Tau Empire.

So anyone not taking a cad or a detachment that has a fortification slot, THAT DOES NOT LIMIT the fortification, is cheating?
Does anyone have a list of all of the detachments have a fortification slot?
It would be interesting to see how many other players out there encounter this?
Related to this:
Someone else at the FLGS brought this up and the proponents brushed it off or denied it.
They say that tournaments allow it, ITC allows it? and that somewhere it's official stated that because Strongholds and Fort book is still in 6th ed., that you can now take any of those fortifications as a formation.

What ITC does is their business and not an indicator of what is or is not "legal". From the ITC current rules page: https://www.frontlinegaming.org/community/frontline-gamings-independent-tournament-circuit/itc-2015-season-40k-tournament-format/ Regardless of Detachments, no more than 1 Fortification and/or 1 Super Heavy/Gargantuan Lord of War may be taken from the allowed LoW list, below. Exception: One detachment in your army may include an Imperial Knight. So long as the detachment restrictions allow for multiple LoW, you may exceed the 0-1 LoW restriction within this detachment so long as all other LoW are also Imperial Knights. Exception: One detachment in your army may include a unit of Tau Stormsurge. This unit may contain more than one Stormsurge model. Note: A Fortification does not count as a model in your army for the purposes of gaining detachment special rules unless that detachment specifically mentions Fortifications as benefiting form them.

Regardless of the actual ruling, I'd be arguing that people shouldn't be using rules they don't own - they might claim to know and understand all of the rules without having the book, but that doesn't help an opponent who wishes to see the book with the relevant rules in it! It's the same as showing up with an Allied detachment of Daemons to a Chaos Marine army, but not bothering to bring the Daemon codex because "Battlescribe says it's okay". At the end of the day, it's common courtesy to have any rules you're using on your person to allow your opponent access to them.

Since anyone can use that, if someone takes a basic CAD, then they can have a formation, right.
So who is taking formations without the option to?

- Right, if you take a CAD or any of the detachments listed you can take a fortification from the Strongholds and Assault book.
- There are people who regularly take fortifications as a formation along with other detachments / formations.
-- The issue being that fortifications can't be taken as a formation on its own.

Not everyone uses the basic CAD. Indeed, the new super/meta-detachments tend to have such high minimum requirements that they squeeze out the CAD option anywhere below about 2k points. Plus they are also so attractive in terms of special rules that the good ol' Combined Arms Detachment tends to look a bit stale. And few of them, so far, have a Fortification slot.

If you simply search the battlescribe thread, here in Dakka, you'll see the creator made it a formation for ease of programming in battlescribe. Nothing else......

This is wrong.
Detachments usually use something in the lines of "all most be of faction X or have no faction". There are fortifications with a non neutral faction.

For your friends at the FLGS:
The ITC doesn't allow it, the ITC actually further restricts the use of Fortifications. Your friends should really brush up their rule knowledge, especially if they start citing ITC rules as if that makes them a "pro player" or whatever.
RAW you gain one Fortification slot per CAD. Some other Detachments also grant you Fortification slots, as someone already listed.
The ITC however limits you to one Fortification slot total, but it doesn't hand it to you. All they do is say "look, if you bring 2 CADs you can still only bring a single Fortification":

Don't trust that list. I know off-hand that Dark Eldar do not get a fortification slot or a LOW with their Realspace Raiders. If they have those slots listed as available there are mistakes and could be more with the other detachments.

"Tournaments" do not allow it. If a few do that proves nothing.

No, that is not stated anywhere.
