The thing is with Brets is they already looked like historical miniatures and that means there were lots of alternatives for players to buy. Not from companies trying to rip off GW but from companies that were making medieval miniatures in 28mm.
The old empire models have the same problem with renaissance miniature games. When we see a new human faction I bet they won't be largely analogous to a historical human culture and will instead have their own unique look. It won't stop other companies from making similar miniatures, but it will ensure that the army has its own niche not already covered by historicals or other fantasy miniature lines.
Add that to the business model I think we're seeing now with GW, where rather than cycle through each of the armies each edition they instead constantly make new stuff and new factions - it doesn't matter if another company eventually copies a GW faction as they will have already made their money on the kits and ready to release the next new shiney faction.
A good example of the non- GW historical figures in 28 MM can be found here: http://www.wargamesfoundry.com/medieval/early-medieval-barons-wars you can really see that any of these figs would fit fine in a Bertonian army. The sculpts are little less polished than GWs, but the price is right, and aside from GW tournament I can't imagine anyone having a problem with them as proxies for OOP Bertonnian models. Browse around to find empire/free peoples units. With that said, not all companies in the 28 MM space were producing non-derivative works, chapterhouse was straight making 40k knock offs while skirting IP laws (or just outright ignoring them). The expense for that lawsuit got passed to us as consumers, and thanks to chapterhouses shenanigans GW has become a shittier company for it's customers (which surprised us all because we didn't think that was possible).

Agies Grimm:The "Learn to play, bro" mentality is mostly just a way for someone to try to shame you by implying that their metaphorical nerd-wiener is bigger than yours. Which, ironically, I think nerds do even more vehemently than jocks.
Everything is made up and the points don't matter. 40K or Who's Line is it Anyway?

Someone in the news section posted a rumor from several months ago, the rumor monger predicting Archaon and the iron jaw boars. He also said the new dwarfs will get a golem like mini with cannons on top of it. We all know that GW plans things in advance and someone linked this picture in the topic. This is an 8th artwork right? Look at the picture in the background on the dwarf side.

I always wonder about those things in that art. They looked really interesting and so does those air ships in the sky.

I'm still waiting to see where they go with dwarfs. Right before AoS came out, I bought a box of Thunderers as a way of dipping my toes into the water, but then once it became apparent everything was changing I decided to wait before buying any more. I really like the idea of Toklienish dwarfs, so the Fyreslayers don't really do much for me, but the steamheads might do(despite the silly name) since I do like a bit of steampunk in my dwarfs too. Hopefully GW doesn't try too hard got make them too unique(like the Fyreslayers) and makes them at least recognizable to fans of more traditional fantasy dwarfs. In the mean time, I'm in the middle of building a Kings of War dwarf army with Mantic models, and while I'd like to have dwarfs in the Age of Sigmar, I might have to keep them in the world of rank and file.

I... don't think so. The steam heads will be completely new, a la Stormcast. The Dispossessed will get a bonesplittaz-style update with multiple options/box.
Although I think the aesthetic of the Steamheads I'm expecting to see as a continuation of the gyro-copter / irondrake evolutions.
I'd be 100% okay with that. I love the Irondrake models, but I just have to much nostalgia when it comes to the old school dorf models

I'm guessing for copyright issues we are going to see less and less of the Tolkien ascetics in humans, dwarves, and elves moving forward. We're likey going to see the legacy humans, dwarves, and elves remain untouched and "remanent" in the fluff with more fyreslayer esque for the core order races moving forward.
