I ordered 2 sets of Ork Boyz and a blister of Green Stuff 2 weeks ago. The site said they had all of them in stock. I paid extra for overnight delivery and waited...
I got an email from them the next day saying sorry for the buggerup, but the website was incorrect. They had 2 sets of Nobs instead of boyz, so they'll have to order them in especially. Right. I can deal with that. They promised it would be here by the beginning of the next week.
Well, I've waited a week ON TOP of what they promised and the website still says they're waiting for stock.
Should I complain? Can I ask some sort of compensation, e.g. at least the extra cash I paid for the "speedy delivery"?

I think you'd be within your rights to ask for you money back for 'speedy delivery'. It's not your fault their inventory control doesn't function.

Hey, the customer service is fantastic. The guy I spoke to via email was great, he even got the Cthulhu referance in my auto-signature. It's just the delivery that's not happening.
Another mate of mine got his AoBR set very quickly, but it seems that mine's just not working...

If you paid for rush delivery, and they can't rush, then they should refund that charge because they aren't delivering the service that you paid for.

Exactly right. You paid for speedy delivery. You haven't had speedy delivery. You are owed the postage fee.
You could cancel the entire order and get all your money back on the basis that you only ordered because they said they had the items in stock.

But any site that put that option up should have the items in stock. Or else they shouldnt bother.

That's believable if they say that it was going to arrive in the first week or so.
4 or 5 weeks in, no, that's not believable.
I've had FW stuff arrive shipped from England in less time.

That might satisfy the customer in which case no problem, but he already seems dissatisfied as he has complained here.
The implied conditions of the contract are that the items were in stock for immediate shipment and he wanted them shipped overnight, and that is why he placed the order.
Shipping the items overnight a week later clearly doesn't satisfy the conditions.

One thing to consider regarding the overnight delivery option. I have seen some etailers who, once the item comes back into stock, will not overnight it unless you have paid for it. I personally htink that if there is an item on backorder it needs to be shipped ASAP, however that is open to exploits as well so different companies have different policies. However, if you get them to refund the cash you paid for the shipping you might be left waiting for whatever time standard shipping takes on top of the restock time.
In short (too late), I would recommend OP speak with CustServ and determine what smelly troll is willing to do about it. Some etailers see stock and shipping as two completely seperate entities, and you may get some suprises here. Look before you leap. And dont use these punks again.
