Yes. It's not state action so the 1st amendment doesn't apply.
A similar case came up when a neighborhood association had a "no flags" policy, and it was upheld as a legal covenant.
The flip side here, as always, is do you feel comfortable telling a property owner what they can or can't allow on their property? Governments do that all the time, but it's hard to read patriotism as a protected class.
Don't get me wrong, I think it's a stupid policy, but if as a business they think it's better for them to cater to people that don't want to look at the american flag, go for it.

Ugh. I'm loathe to say it, but if it's the management's property he should have the right to ban whatever symbols he wants. Even if it means the American flag due to him considering it "offensive".
I hope he loses business until he changes his mind, but as far as I'm concerned he's acting within his rights.

I think that this is going to go poorly for the management. In the Information Age why do people think that things like this will go unnoticed? As a PR practitioner I wouldn't touch this guys business with a 10 ft pole. This was a dumb idea, that is only going to attract negative attention...

Considering it's an apartment you would probably be out on your ass by the time you got to #3. Eviction notices are hard to ignore. This isn't a state or rights issue so long as there was a line in the lease you signed stating they can do this. If there isn't then they can't, but since people are protesting, and not suing or ignoring it, it most likely means they don't have much in the way of a say in the issue. It's stupid, but god damn do I not care what some random apartment complex in oregon is doing. :edit: How did you edit it before I even responded, when I didn't click quote on the edited response? Goddamn, you're quick.

Well I live under one right now. It didn't seem like the kind of agreement that couldn't have a "No flags" policy in there. It had a few lines about what I was and was not allowed to do with the lawn/parking spaces/building exterior.

Difficult to see how flying a US flag could be considered offensive in the US. Don't all post offices fly US flags?
If the flag was North Korea or Iranian or something I could imagine a potential problem.

I have heard of similar things happening over here.
The landlord of my local had put up a load of English flags outsude the pub during the last Euro football tournament and was suprised when the local Police asked him to take them down in case they offended the local Muslim population. Thankfuly in this case comon sense prevailed, he refused to do so and the Police couldn't make him so they backed down.
Funny thing is, I believe that it takes a lot to genuinely offend someone, there seem to be a lot of people out there who "choose" to be offended so that they can have their 5 minutes of fame, standing up for what ever cause they are believing in that week. The current climate of political correctness has us pandering to these types.
Sadly all political correctness seems to achieve is creating a negative feeling towards the very minorities it misguidingly tries to protect. It also encourages people to "cry wolf" and make out they are offended by the slightest thing, thus desensitising us all for when something genuinely offensive occurs.
People seem to be confusing getting offended with being over sensetive and a bit annoyed.

True that. There was a case where a British Airways staff member was threatened with disciplinary action for refusing to take off a crucifix badge (IIRC) at work. The implication was that a muslim might see it and race to the nearest hardware store to load up on box-cutters... I mean, I'm not exactly full to the brim with Jesus juice (being an Atheist) but that wouldn't offend me at all. Who gets offended by that? Tossers, that's who.
Saying that, the case where a nurse was prevented from praying for her patients? I fully supported that.
But flags? Nah man, fly your flag high! If it offends someone, it's their problem. Come the World Cup next summer, I'm gonna look like the George Cross threw up on me! En-ger-land!

Actually the BA crucifix case was to do with breaching uniform rules about not wearing jewellry.
The rules themselves could be considered discriminatory as they allowed Sikhs to wear their sacred jewellry. OTOH the crucifix isn't an item of Christian sacred personal jewellry, and if you allowed that you would have to allow everything, which would void the point of the rule.
The employee lost her case.

I'm trying to figure out how someone could be offended by seeing a flag. I can't even fathom what statement the flag might be making that someone would find offensive. 'I'm proud to be American’ … I don’t get it.
On the other hand, flags can be associated with a certain socio-economic class, and coupled with a lot of other things if a complex had a lot of flags it might be considered redneck. I can understand an apartment complex banning flags to avoid that perception.
If the decision were made I could understand a business owner making the decision to tell tenants they should take down flags ‘to avoid offence’. Even though the offence thing makes no sense, it would be a lot easier than saying ‘your flag makes us look like rednecks’.
Which is a long bow to draw, but it seems the most likely option because I can’t for the life of me figure out how the flying the US flag could offend someone. The St George Cross I can understand, because it has a long history of being co-opted by nationalist, racist groups in the UK. But as far as I’m aware no such history exists in the US.

I can imagine people being offended by a Nazi flag, or a Soviet flag perhaps, or even a Confederate States flag.
So the thought process goes: "Some people might be offended by some flags. Ban all flags."
