I was discussing it with my brother and he doesn't want o hear about it, as far as he is concerned I can't and he wants to make it a house rule

Personally, I'd allow it. But it's murky enough that I can see where your brother is coming from. As we're getting into house rule territory, it's entirely up to the two of you to decide between yourselves - an Internet forum can't really decide what makes the game most easily playable and/or fun for you.
