San Francisco cyclist pleads not guilty in fatal crash
SAN FRANCISCO (Reuters) - A software developer pleaded not guilty on Wednesday to a charge of vehicular manslaughter in the death of an elderly man he is accused of recklessly plowing into while bicycling downhill through a San Francisco intersection.
The case, a rare felony prosecution of a bicycle rider for a fatal accident, comes amid a 71 percent increase in bike traffic in San Francisco in the past five years. It also marks the third instance in which a pedestrian has been killed by a cyclist during the past year in the Bay Area.
Chris Bucchere, 36, is accused of speeding downhill through a red light and into an intersection crowded with pedestrians in the city's Castro District on March 29. He ended up striking Sutchi Hui, 71, who was crossing the street with his wife and died of his injuries four days later.
Evidence against Bucchere, who is free on $150,000 bond, includes several eyewitnesses and a surveillance video that have helped investigators put his estimated speed at up to 35 miles per hour.
A spokeswoman for District Attorney George Gascon's office, Stephanie Ong Stillman, said investigators had evidence Bucchere also ran a number of stop signs on his way downhill to the intersection where the crash occurred.
Authorities also suspect Bucchere was the author of an online blog post about the accident in which the cyclist recalled being "too committed" to stop at the traffic light before going through it.
"I laid it down and just plowed through the crowded crosswalk in the least-populated place I could find," the post said, going on to describe a "river of blood on the asphalt" in the aftermath of the collision.
The San Francisco Chronicle said Bucchere had been trying to set a speed record for a popular bike route through that neighborhood, and an electronic monitoring device on his bike provided investigators with some of their evidence against him.
In a written statement issued to reporters at the courthouse on Wednesday, Bucchere's lawyer, Julie Salamon, said her client "anticipates the day when he may express his deepest condolences to the Hui family for their tragic loss. But for now, while the case is ongoing, he will continue to cooperate with the authorities and to respond responsibly to the charges in court."
Bucchere, who left the courthouse without speaking to reporters following his 10-minute arraignment, is due back in court on July 27, when the judge will set a date for a preliminary hearing.
Stillman said Bucchere was the first bicyclist charged by Gascon with felony vehicular manslaughter, an offense for which prosecutors must show gross negligence and is punishable by up to six years in prison.
In March, cyclist Randolph Ang, 23, pleaded guilty to misdemeanor vehicular manslaughter for running down a 67-year-old woman who died a month later. He was sentenced to three years' probation and 500 hours of community service.
In a more recent accident, a 92-year-old woman was struck and killed by a cyclist in a crosswalk near El Cerrito, east of San Francisco.

I fail to understand the mind of these types of cyclists that seem to think that just because they are riding a non-motorized vehicle, somehow traffic laws don't apply to them or that they don't need to pay attention to what goes around them...
Just last week I had the sobering experience of witnessing one of said creatures get his brain splattered all over the asphalt when he tried to cross a motorway where cars usually go at 100+ kph! And yesterday I almost crashed my motorbike into a women that was happily ridding on the roadside in the OPPOSITE direction of traffic!

Some cyclists do tend to ignore the rules of the road - the number of times I've seen them pop off the road and onto the pavement in order to skip red lights or any number of other things (including just riding straight through red lights) just beggers belief.

Cyclists around here are utter donkey-caves. I watch them blow through intersections all the time. They refuse to use the bike lanes when they exist.

Yea, as an avid cyclist, I definitely obey the laws of the road, and teach my kids the same thing. Mainly for my/their own protection from cars. But this is kind of the other way around. Still, guy is totally guilty and deserves whatever sentence he gets

When I cycle, I obey traffic laws, use hand signals (good and bad), and look both ways before crossing a street. It's what you're supposed to do! Especially with all of the damn monster trucks and suburbans in Houston.

That sounds really bad for this dude. If it's all true, he deserves jail time for manslaughter.

Funny story, while standing waiting for a bus just now (waiting 20 mins) I saw two cycling no-no's from 2 different cyclists. One cyclist (with no helmet) swerved out in the middle of the road while talking to someone on the pavement, then went straight through a red light.
The second(also with no helmet) swerved onto the wrong side of the road (not sure if he signalled as he came from behind me), doddered along for a while before swerving onto the pavement - bags of shopping hung from his handle bars...

When I first started this story, I was thinking "Yup, he probably deserves to be punished".
By the time I was done with it, after reading about just how amazingly reckless this guy is, I started thinking we need to come up with a better punishment for people like this. Perhaps 2nd degree murder would be fitting.

Haha right yes, on some kind of 'dead man' trigger?
Just another example of the natural pecking order on the road unfortunately; Trucks -> vans -> cars -> motorcycles ->pushbikes -> pedestrians.
After riding a motorbike for some years you learn that the majority of other road users are braindead, and are incapable of turning their necks 45 degrees. I hate to say it but a lot of old people in particular shouldn't have a license, just the other week my back wheel must have been a foot off the ground (at least it felt like - I was probably within a foot of T-boning the car) because an elderly gent neglected to look before sailing out of a junction. I would be interested to see the fatality statistics of RTA's involved people over 70, but I guess it happens that often that it isn't newsworthy.

In the area where I live currently, bike lanes are no safer for cyclists than the highways... the idiot vehicle drivers view those lanes as their personal turn lanes, and "ohh traffic is backed up for over a mile, I'm gonna make my turn and drive down this nice lane here" type things.... I basically won't ride my bike in certain parts of the city, or by myself around here... Of course, soldiers are notoriously bad drivers in civilian vehicles for some odd reason....
