Supreme Court: Lying about military medals is protected by Constitution

The Supreme Court on Thursday struck down a federal law that made it a crime to falsely claim being awarded a top military honor, saying the law infringed on the Constitution’s First Amendment protection of free speech.
The court ruling concerned the Stolen Valor Act, under which a California man, Xavier Alvarez, was convicted for claiming falsely in 2007 that he had been awarded the Medal of Honor, the nation’s highest award for valor.
But Alvarez’s attorneys convinced a lower court that his untruths were protected by the First Amendment’s guarantee of free speech. And Thursday the Supreme Court agreed.
“Content based restrictions on speech have been permitted only for a few historic categories ... including incitement, obscenity, defamation,” the court wrote in a summary .
“The Act seeks to control and suppress all false statements on this one subject in almost limitless times and settings,” the court wrote. “Permitting the Government to decree this speech to be a criminal offense would endorse government authority to compile a list of subjects about which false statements are punishable.”
Jan C. Scruggs, founder of the Vietnam Veterans Memorial Fund, which built the Wall, commented in an e-mail: “The Court has ruled that the First Amendment protects a wide range of obnoxious behavior including this.
“Public humiliation is now the most effective tool to expose the delusional Walter Mittys of American Society,” he added. “Military recruiters are happy to welcome those desiring to be valorous in combat into the Armed Forces.”
Other veterans groups expressed dismay.
“The Veterans of Foreign Wars of the U.S. is greatly disappointed,” the organization’s commander in chief, Richard L. Denoyer, said in a statement. “Despite the ruling, the VFW will continue to challenge far-fetched stories, and to publicize these false heroes to the broadest extent possible as a deterrent to others.”
The case has generated huge interest and divided First Amendment advocates, including the media, and veterans groups, who saw the act as a necessary weapon to discourage what appears to a boomlet of self-aggrandizers.
According to a brief filed by the Veterans of Foreign Wars and two dozen veterans groups, “Pretenders have included a U.S. Attorney, member of Congress, ambassador, judge, Pulitzer Prize-winning historian and bestselling author, manager of a Major League Baseball team, Navy captain, police chief, top executive at a world-famous research laboratory, director of state veterans programs, university administrator, pastor, candidate for countywide office, mayor, physician, and more than one police officer.”
The Supreme Court in recent years has been protective of speech rights in several high-profile cases. The court struck down a broadly written law on depicting animal cruelty, upheld the rights of a controversial group that demonstrates at military funerals and blocked a California law that attempted to outlaw the sale of violent video games to minors.
The Reporters Committee for Freedom of the Press and 23 news organizations, including The Washington Post, filed a brief supporting Alvarez to argue that upholding the law would reverse “the basic presumption against official oversight of expression.”
Veterans groups, on the other hand, said falsely claiming the honors was theft.
In preparation of an adverse ruling from the court, some in Congress have endorsed a version of the law that would make it a crime to benefit from lying about being an award-winner.
In arguments last February, the court pondered whether the First Amendment allows the government to prosecute people for lying about earning military honors, and, if so, what else might be fair game.
Solicitor General Donald V. Verrilli Jr., arguing on behalf of the law, contended that the statute is “about as narrow as you can get,” and targets with “pinpoint accuracy” only “calculated factual falsehoods.”
The government since the days of George Washington has shown an interest in promoting valor and bravery in its military and keeping “charlatans” from usurping that glory, he argued.
The act allowed a fine and/or a six-month prison term for someone who “falsely represents himself or herself, verbally or in writing, to have been awarded any decoration or medal authorized by Congress for the Armed Forces of the United States.”
The penalty increases to a year in prison if the person lies about a Purple Heart, a Medal of Honor or another particularly high honor.
There was no question that Alvarez lied. After winning a seat on Southern California’s Three Valleys Municipal Water District board of directors in 2007, he introduced himself by saying: “I’m a retired Marine of 25 years. I retired in the year 2001. Back in 1987, I was awarded the Congressional Medal of Honor. I got wounded many times by the same guy.”
None of that was true. But a district judge overturned Alvarez’s conviction by declaring the law a violation of the First Amendment.
Others disagreed. Ninth Circuit court Judge Diarmuid O’Scannlain had held that the decision to find the law unconstitutional “runs counter to nearly forty years of Supreme Court precedent” in which the court “has steadfastly instructed that false statements of fact are not protected by the First Amendment.”

Lots of people are going to be angry about this, but this decision is for the best. That law was only a few links in a chain away from the government creating lists of prohibited speech. Becuase the general rule is that if the government can do something, they will.

Well, maybe Mr. Alvarez needs to meet an actual MoH holder.... funny thing is, that claim is easily researched.

I have a lot of military friends that are super-pissed about this, but I'm not all that bothered. If someone lies about getting a medal I don't see how it demeans the people who actually wanted theirs.

Having recently switched jobs, my new employer had an interesting system of me having to certify everything I told them was true. Had I lied, it would have (according to their forms, I'm no lawyer) been a breach of contract, and (as some of the forms were federal forms for a security clearance) lying on a federal form (which apparently is a huge nono punishable by jail time). I expect many companies (and especially those that require a clearance) will follow suit.
Not that it stops some scummy politician (like the schmuck who started this whole brujaha) from getting up there, but then, who actually believes anything a politician says anymore?

Uh... no. Making false statements has never been against the law in 99% of situations out there. Lying in court when under oath, on the other hand, will remain a crime. As stated before, lying on a federal form, for instance, is still against the law.

You're comparing apples to oranges though.
The ruling is saying "The government shouldn't have a list of topics that it is not okay to lie about".
Perjury is a crime regardless of subject, because you are lying under oath, in a court room setting. The perjury charge doesn't care WHAT you lied about, just THAT you lied.
This ruling is in direct relation to a law that made it illegal to lie about being a Medal recipient.

Well people don't just lie about getting the Medal of Honor. They lie about everything in regards to service history. It seems like there's always someone getting called out for lying about their service history. There was one guy in the papers last week lying about serving in Vietnam, some punk politician IIRC.
I don't know if I would call it an insult to those who actually did serve, but people are definitely falsifying information for personal benefit and that needs to stop.

It's not, but people lie about it for career advancement or just to brag.
I worked with a guy who was around 150lbs overweight, had about 5 teeth, and appeared to be constantly covered in filth. He claimed to have been a Ranger. Other guy at work who actually had a Ranger Tab (that's all I know, he didn't talk about it) finally snapped and knocked that lying SoB out. Bragging about SF service is a good way to get called out hard by someone who has actually been in that community or has close ties to it. There's always some dill weed claiming to have been in Delta Force on secret Rambo missions where they were awarded more medals than a banana dictator.

I don't give a gak either... Your friends probably care because they don't really earn their medals!
Seriously, they give medals away like candy anyway! I was on the ground in Iraq a week before shock and awe started, I spent about 6 weeks literally living in a hole in the ground and nothing else, behind enemy lines and constantly getting fethed about, with nothing to eat but MRE's and nothing to drink but water. No idea what was happening one day to the next, and when the war finished a few weeks later we re-orged in Basrah, sat on our arses getting ate by flies for a few months and then fethed off home.
The fat navy sailors that spent the whole time drinking cold beer and chasing skirt a few hundred miles off shore on a ship got the exact same medal I did minus a gakky rosette, and there are endless amounts of REMF servicemen and women now who rotate through Afghanistan for 30 days (minimum for a medal) and basically do feth all but sit in the huge camps drinking Starbucks.. I say a bloke who takes the time to make gak up and ebay a uniform has earned the right to wear a gong as much as those fethers!
And you dont even wanna hear half my stories about the US national guard... they have more medals than Field Marshal Montgomery and they do about as much work as the ships cat.. At least some bullshitter with a convincing story, decent acting abilities and paypal had to put SOME kind of effort in!
People can say what they like.. If you want to claim you served, that's your business you sad bastard.
If it helps sad blokes who would otherwise die virgins get laid, I am more than happy to do the actual killing to assist them.

If you lied about getting a medal on an SF89 I feel like breach of contract is the least of your concerns. You are going to be investigated for a clearance, maybe not as hard for a Secret, but the Lord fething help you for a TS. Lying about military service or awards in that circumstance makes you unqualified by reason of stupidity: to wash dishes.

Meh, I'm bothered by the precedent it sets but in a way I've always thought that things like this should be settled "in house."

I had another NCO, completely unrelated to my chain of concern have a gak fit and nearly a fist fight with our top because a joe in my section got the same medal as I did (as the section leader). I never really got what he was on about in the first place since I was on my way out the door, but it mattered to him...A LOT.
